Brann takes Senator John Sherman
to ta"k in a rpurt of froth) deolarna
too for haying le could not oppose
tho clearly ascerinnod wishes oi the
people on a puliiio question but the
position assumed h Senator Sherman
iH both sensible and patriotic. It is
presumption and arrogauee in any
man to claim to po-ssess a larger
measure of nene sagacity and judg-
ment than million'- of well educated
oitizcnp and to set bimsel in opposi
tion to their wishes solely on the as-
sumption that he in inferior to them in
a knowledge of uhit would be condu

want of prdcticalnoss and his tedand
ance of self conceit. The Statesman
submits to circumstance-- wien they
become too imperious to bo controlled
by him just as the manner lurls his
sails when tho tempest is about to
burst or tacks to avoid tho breakers
in irout of his vessel. Timely con-
cession nirs revolution in the bud
obstinacy and ooerciou add fuel to the
fume of popular discontent and for
mentation. In the United States we
wunr no dictators and autocrats. Brann
is as impracticable and erratic as it is
possible for a mun to be and not only
opinionated and tsclf conceited to a
high degree but ho imagines God has
deputed him to knock creeds political
and moral on the head and fashion
things to buit himself. No doubt he
ft els as did the 'King of Castile'
that "had God consulted him when
creating tho world he could have
givea him a vast deal of usi ful ml
viae" but yet awhile he is too politic
to blurt it out. Ono of his crotchets
is to disd.nn to obey the dictates of
policy or moro prope ly of dioretion
which is rather out of place in a paper
that has nlway made policy us com-
pass and hailed before the trado winds
A multitude of new statutes and
amendments ol existing statutes is
bimply a hot bid of litigation and
confusion us all such new statutes
and amendments must bo carried to
the appelUto courts for interpreta-
tion. This is peouli.uly tho case with
criminal statutes ot a new impression.
The appellate courts are frrqaeiitU
intense sticklers for the observance
of technienlities and sometimes push
hyperoriticism and juiioial casuistry
to an excess and contuvo to open u
door for the escape of criminals who
richly descrvo punishment. Judge-
made law is always vioious and yet
the courts must construo every statuto
weigh the punctuation of the sen-
tences and say what the sutute
means from their standpoint. An
eminent English judgo declared that
'a law or a decision that waa contraiy
to reason and common sense was not
law as law was founded on reason and
common sonse." And every judge
and law maker would do well to steer
by tho same compass. Laws that are
in a stuto of fluctuation not only
breedlitigatiou but but involvo in-
nocont persons in ruin. Stablo laws
are the best and safest.
Tho Austin correspondent of tho

great a strain in his effert to be witty
humorous and sarcastic. He had

It goes witti jut saying that thero
are "b'ack f-heep" in all callings pro-

are pettif'ggers in thelrgal profession
and quacKs in the medical profe-sion.
; But the lawyers of Texas do not begin
to deserve the vile terms belched

elected a senator in congress by the
fiiends of CjV Hogg and that Mills
is to get a place in Cleveland's cabinet

This story is simply one of iiraun's

Rigglns' Reasons for School Board
Elected by the People.
1. Voting for an aldciman we
don't know whether he is to be put on
"i're committee" to judge of horses
and the like or sehnol committee to
judgo of teachers and the like. A
man might have a lino "smellci" and
j be a fine judgo of the condition of
our ahcy s. etc and be a very poor
juage ot a scnool room or teucher
The Waco people and tax p en
ought to havj a say as to whom
this mast important of all things in a
ciiy is committed the education of
our children.
2. The school superintendent asks
the major to appoint trieuds on the
sonool committee. This method cuts
off any appeal fioin a teacher to the
school oommittee or city counoil
(Look for example at this last year.)
Thero are live members of this school
committee. With its vote oi the
mayor who appointed this com
mlttee they can cany any
matter over the whole city
and thus cut oil the head of any
toaehcr or taxpayer condemn witlu ui
a healing. This is daneerous and
simply leaves us in a one man or one
woman power.
I). It brings n matter whioh should
be abovn phtical tactions into th

Suppose we hud sueh men as Mr. E.
Hotae J. N Gallagher J. B Scar-
borough or J. E. Boynton whose live
and characters so eminently tit them
for such positions on our sohool
board. These andotheis of their make
up would lie glad and willing to serve
the city ol Waco without compensa-
tion. Is thero a man to doubt that there
would be a vast improvement?
Our line of thought ior several
years has been ono from principle and
we havo said what we believed was a
good or injury to Waco and we havo
paid it without policy without fear or
favor. If it has hurt let it hurt. If
good has been done our solo object
as a citizen and business man has
j boen accomplished
If some egotibtioal soft braiu has
attributed our motive to any porsonal
prejudice against any one we are
sorry for sueh a being and he only
proes that he has been boru and
bred in a lowor strata of 1 le than wo
over knew. But thanks be to the cold
truth the peoplo of Waco believe as
we do and believe in tho pnee-s and
