known heirs of Wm. M. Baylor, Wal-

cept plaintiff being hereinafter called

1. That on or about the first day
of December, 1906, plaintiff was law-
fully seized and possessed of the fol-

place of beginning, and that on the
day and year last aforesaid defend-
ant unlawfully entered upon said
premises and ejected plaintiff there-
from, and unlawfully withhold from
him the possession thereof, to his
damage |5000; and that the reason-
able annual rental value of said land
and premises is 1500.
2. That plaintiff claiming to be
the true and lawful owner of the
above described tract of land, has
had and held under color of title
from and under the State of Texas,
peaceable, continuous and adverse
possession thereof for a period of
more than three years next preceding
said date of December 1, 1906, which
he is ready to verify.
3. That he, plaintiff, and those
whose estate he has, claiming the
same under deeds duly registered,
have had peaceable, continuous and
adver*» possession of the above de-
scribed land and tenements, culti-
vating, using and enjoying the same,
and paying all taxes due thereon,
for a period of more than live years
