The attorney general, in reply to
questions, advised an election officcr
as follow.: Every person must vote
in tbe voting precinpt iu which he re
side.. In state elections a residence
of one year in the state next preced
ing the election and an actual and
bona fide residence in the precinct
where the person wishes entitle, such
persons to vote at such ejections in
that precinct, provided he po.se.bo.
the other qualifications required by
law. The provision with regard to a
residence of six months applies only
to district and county elections.
Under article J688, Revised Statutes,
the foregoing is applicable to per
sons of foreign birtb, although they
might not have filod their deolara
tlons to beoome citizens until one
day before tbe election. Under sec
tion 2161, Revised Statutes, as
amended, persons can tile their de
derations before any cenrt of record
having a clerk and seal and common
law jurisdiction.. ¡ This would pérmit
declarations to be filed and the oath
made before the clerk of the District
or County Court. This ruling is im
portant, as it is said to be the inten
tion of prohibitionists at certain
points to challenge the votes of for-
eign born Citizens on the ground they
should file their oath one year before
the election. The statute appears to
be very plainly followed by tbe at
torney general or by his assistant,
Col. Harrison, who furnishes the rul-
ing in the abeenoe of (Jen. Hogg.
