COURT OF CIVIL APPEALS HOLDS
THAT HE’S ENTITLED TO DAM-
AGES AGAINST RAILROAD.
The case of the International and
Great Northern Railroad Comapny
against John Homer Ing, appeal from
Travis county, was affirmed in the
court of civil appeals. The appelle re-
covered judgment against the railroad
company in the lower court for $502
damages for having been forcibly
ejected from the train between Austin
and San Antonio. Ing purchased an
excursion ticket from a third party for
San Antonio and the conductor pro-
। nounced the ticket no good and put
Ing off the train and for this he re-
covered damages and the case was af-
firmed.
The court of civil appeals overruled
the contention of the railroad com-
pany that the ticket referred to did
not embody a contract entitling the
plaintiff to transportation on appel-
pelant’s road, the court holding that
a railroad passenger ticket is trans-
ferable.

Hamplin et al., contestants, against C.
M.-Rogers, executor, was filed on an
appeal from the county court.
—The court of criminal appeals yes-
terday reversed and dismissed the
case of J. E. Eagan from McLennan
county. Eagan is in the Ice business at
Waco and was charged with having
failed to pay a tax of $75 as being an
ice dealer. After carefully consider-
ing the facts in the case, the court
held that Eagan was not an ice dealer,
but a manufacturer and consequently
not subject to the payment of the tax
and accordingly dismissed the case.
—The court of cl|il appeals yester-
day reversed and remanded the case
of the Citizens’ Railway company vs.
Nancy C. Gossett et al., from MoLen-
nan county. Nancy Gosett et al., re-
covered judgment in the trial court at
Waco for 12500 damages on account
of the killing of Wm. J. Gosstfhus-
band of Nancy C. Gossett and father
of the minor children. Gosse was
crossing the tracks of the railroad
company and alleged that the defec-
tive rails, when in contact with the
wheels of his wagon, caused him to be
thrown to the ground, fracturing his
skull, from which he died. The court
held that from the evidenceadduced
that the deceased was guilty of con-
tributory negligence and reversed and
remanded the case.

Thirty head of cattle were impound-
ded yesterday by the police and pound-
master combined. This is a record-
breaker. In the forenoon six head
were run in by Officers Gibson and
Jones, and the balance were impound-
ed by Officers Lane and Gibson and
Poundmaster Corwin. Mr. Gibson
stated last night that they could have
caught many more, , but that they
drove those just inside of the line back
into free territory. The green grass is
the cause of the stock wandering so
much more than usual.

Since The Statesman announced the
fact several days ago that Mr. Geo.
Matthews Intended entering the race
for sheriff in the place of Sheriff
Davis who has retired from the race,
by reason of III health. Mr. Matthews
has received warm congratulations
from many sections of the country .and
earnest expressions of well wishes.
In this Issue of The Statesman he an-
nounces himself formally for the posi-
tion in question and there Is every
reason to believe' that he will make a
successful race. He has been connec-
ed with the sheriff's office in this
county for four years past, having
served two years under Sheriff White
and two under Sheriff Davis, and for
that reason is eminently qualified to
filled the arduous duties of the office
he is seeking. It is meet and proper
that a man should be qualified for any
position he seeks before he asks the
public to support him and in Mr. Mat-
thews’ case the qualifications are ap-
parent. He has proven himself, a
careful and painstaking officer and has
practically been in charge of the sher-
iff's office since Mr. Davis’ protracted
illness. He is a consistent democrat,
a young man of physical strength,
moral-worth and most excellent stand-
ing in this community and comes be-
fore the public today without any fear
as to his future success.
