The federal government
has dropped its appeal of
a $16.2 million award to
ExxonMobil after request-
ing its discontinuation in
the Fifth Circuit Court of
Appeals in New Orleans.
The award was granted
to the petrochemical giant
after U.S. District Judge
Lee Rosenthal held the
United States responsible
for discharging pollution
at the Baytown site during
World War II when aviation
fuel and rubber were being
produced for the war effort.
The same was true for the
Korean War.
Aaron Stryk, ExxonMo-
bil spokesman, issued a
statement on the dropped
appeal.
“We agree with the dis-
missal of the government’s
appeal that supports Exx-
onMobil’s recovery on its
claim that the government
is liable for a proportionate
share of the cleanup costs,”
Stryk said.
No reason was given in
court records about why
the government dropped
the appeal.
Attorneys attempted to
argue the judge viewed
the case as a “contribu-
tion case,” where a claim
is brought by defendants
to litigation for monetary
dam ages by a plaintiff under
the Comprehensive Envi-
ronmental Response, Com-
pensation and Liability Act.
However, they claimed the
wrong statute of limitations
was applied. Government
lawyers argued ExxonMo-
bil should have brought the
case in 1995, which was
within three years of the
