Over $1,000 of stolen fishing
equipment has been recovered
by the Upshur County Sheriff’s
Department and returned to its
rightful owner.
A Farmington, Mo. man, who
has made annual fishing trips
to the Gilmer area for the past
16 years, reported the theft to
authorities earlier this week.
Several pieces of equipment,
including rods, reels, lures and
a tackle box, were stolen on two
occasions from the man’s boat.
According to Deputy Wayne
Young, a trail of evidence led
him to the home of two juveniles
from the Ore City area. After
questioning, the boys indicted a
third accomplice, also from the
Ore City area. The youths, ages
13, 14 and 15 have all been
turned over to local juvenile
authorities; no charges were
filed.

The Texas Court of Criminal
Appeals will be asked to recon-
sider its refusal to hear an ap-
peal by Ted Wharton, 56, of Di-
ana for attempted murder in
Oct. 1993.
Wharton’s attorney, Clifton
“Scrappy" Holmes of Longview,
will file the motion for a rehear-
ing after the appellate court re-
fused to hear the case last
Wednesday. Upshur County
District Attorney said the Aus-
tin appeals court rarely grants
such requests.
An Upshur County jury sen-
tenced Wharton to two years in
prison in 1994 for his assault on
Maxey Don Singleton, also of
New Diana.
