favoritism.”
Williams said
Two U.T. El Paso students were apprehended by Campus Police in the Union cafeteria Friday
morning. The two were seen smoking marijuana on the walkway of the Student Union by an officer, Police
Chief Ralph L. Coulter said. “As the officers approached the students,” he said, “they disposed of the
marijuana by dropping it over the edge and then they went into the Union cafeteria.”
An officer later confiscated what was believed to be marijuana under the ledge.
Sergeant Paul L. Ellington and a plain clothes policeman went into the Union and took the suspects into
custody.
As the officers took the two from the Union, some students complained about the actions of the police.
They disliked the manner in which the officers “opened the doors with the students.”
Coulter said “there was no unnecessary force used by the officers. However, one of the students had
attempted to resist.”
The two students were taken before Justice of the Peace Brunson Moore and charged with possession,
according to Coulter.
“Under the same circumstances the downtown newspapers would give their names,” Coulter said, “but for
the sake of the students, we will elect not to release them.”

“No government, be it student
or national is effective and viable
if it has open general elections for
every vacancy it encounters.” It is
infeasable,” William said.
Garcia said that the whole
incident started because of last
week’s article in the Prospector,
which was “inaccurate, incomplete
and misleading.”
Garcia said that when he was
elected president pro-tempore, his
fellow senators were aware of a

Article II, section 5 implies that
the president may fill a vacancy
within the executive branch of
student government. The
inadequacy of the article violates
the student’s right for a voice in a
representative government;
according to the petitioners.
If the appointment of Garcia is
accepted as permanent by the
court, then the acceptance of the
entire constitution is no longer
valid and therefore null and void,
for it will contradict Article II,
section 1, the petitioners said.
The petitioners asserted that
both Williams and Garcia have
violated the constitution of the
Student Association and declare
them as defendants in their
petition to the Supreme Court.
Williams said “Such protest and
contention is healthy because it
keeps the government on its toes
and makes it more receptive
toward the people.”
“If there is any doubt in the
minds of my fellow students, this
will put me on firm ground,”
Garcia said.

Don Williams, president of the

has been approved by two-thirds of
the senate, which followsArticle II,

constitution to the letter.

which states “The chief executive
powers shall be vested in a

They also believe that a
violation exists of Article II,
section II, part 5. This states, “The
president shall have the following
powers and duties: To fill

and the University Judicial System

Although the petitioners are
contesting violations of both these
articles, the defense will be using
these same articles to prove their
case.
