sanity hearing.
The injunction was dissolved Fri-
day and his last hope faded.
The first shock struck Vaughn at
12:33 a. m.
Exactly ten minutes earlier he
had entered the death chamber,
smoking a cigar and clasping three |
roses in his hand—"my funeral
bouquet," he called it—and a Bible.
Innocent, He Says
Vaughn said he was dying an
innocent man.
He spoke a few minutes, puffing
a cigar he had requested a short
time before he began the death |
march.
When spectators fidgeted, he
said:
"I know the people in this room
are under a terrible strain, but it
is nothing compared with the strain |
I’ve been under."
When Warden W. W. Waid said |
it was time, Vaughn said: "The |
law says I die between midnight |
and dawn, and I’d like a few more
puffs on this cigar."
Vaughn began his speech by I
saying: "Gentlemen, I’d like to
say the Lord’s prayer."
Bowing his head, he repeated the
prayer slowly, word for word.
"As I told you before when I
was here last week with death
standing behind me," he said, in-
dicating the electric chair, "you
are going to see an innocent man
executed."
“Another Innocent Man Dead”
Johnny Banks, negro preacher
also sentenced for murder, died
Friday at the appointed time, al-
though he, too, had been saved a
week before when the chair broke
down. Vaughn mentioned him in
his speech.
"Those of you who were here
Friday night saw another innocent
man die, a Negro who celled next
to me on death row and prayed
with me."
He said the prison officials were
doing their sworn duty and that if
it "was left to those men they
would not harm a hair on my
head.”

Better Dead. Allred Says
Austin, Texas, April 30.—Gov.
James V. Allred said:
"There has been too much maud-
lin talk by uninformed persons a-
bout the Vaughn case. There was
just as much reason to commute
the death penalty of the negro,
Johnnie Banks, as the one assessed
against John W. Vaughn; yet not
one one-hundredth of 1 per cent
as many persons petitioned in be-
half of Banks, although he was
scheduled to die with Vaughn when
the machinery broke down last
week.
"There is not the slightest doubt
as to Vaughn’t guilt. He was con-
victed by two different juries and
given the death penalty each time.
He had a fair trial and the benefit
of an appeal to the higher courts.
"In addition to murdering a po-
lice officer, Vaughn admits that on
the same night he committed two
robberies with firearms (punish-
able by death) and stole an auto-
mobile in which he committed all
these crimes.
"At both of his trials Vaughn’s
confession was introduced. At the
first trial he took the witness
stand and admitted the truth of
part of his confession but denied
the other, or rather stated he did
not remember. He did admit on
the witness stand that immediately
preceding the murder he and Don-
ald Baker disguised themselves,
took their pistols, stole an automo-
bile and highjacked two filling
stations.
