Roberts on the 1st day of February,
a. d. 1856, filed their petition in my oflice.
setting forth that Richard Birdsall is justly
indebted to them in the full sum of one hun-
dred and thirty-three dollars and 8 conts, for
money received of the Estate of the late H A.
Poole, while acting in the capacity of agent of
said II. L Stone A Roberts, nnd for which
said sum of money, or any part thereof htii
has hiiherto failed and refused to pay or ac-
count for.
And whereas, oath has been mad * in duo form
that tho said Richard Birdsall is a non-resi-
dent of the State of Texas, so that the ordina-
ry process of law cannot bo sorved upon him.
Theso are therefore to command you that
you cite the said Richard Birdsall by publicn-
of this writ in the San Antonio Lodger, (á
newspaper published in silid county of Boxar)
for four successive weeks previous to the re-
