the month of November last, when defendent severe-

or destitution, that he has not yet returned to his
home, that during the time they lived together as

taining to the marriage state, that she treated him
with great kindness and gentleness, but notwith-
standing all this, his cruel treatment and outrage-
. on. conduct is of such a nature as to render their
living together as man and wife insupportable.—
She prays that the honds of matrimony existing be-
tween them may be disso!ved,and that she have and
retain the child, the fruit of their marriage in her

to ease said landed estate could not be qeaitably di

said executors, or any two of them were authorized

sessed of four thousand six hundred and five acres
of land, leas three hundred acres, situa-ed on the

testator by the Mexican Government. That the
laid Thomas, one of the executors aforesaid has
since deeaased. that the other executors aforsaid

from the neglect of duty have forfeited their right

Wells who is mentioned as one of the Devisees in
