and manfully all their duties growing-out

trust to deliberate as statesmen and to
; continue tbe work of reform prudently and.

From the adjournment to the resumption
of your legislative labors an interval of
more than eight months a kind Providence
has spared the life of each one of our num-
ber of ninety members. We bow in grati-
tude to Him the giver of all good for bis
.msrey aud that the circumstances sur-
rounding us to-day are so different from
those that environed us here one year ago.
Then although the Fourteenth Legislature
was fully organized and in session in this
Cupitol elected (by an overwhelming ma-
jority of the people) in pursuance of a law
enacted by the previous Legislature in con-
formity with the message recommendations
of the Executive and approved by him
yet this same Executive refused to recognize
the Legislature and endeavored to prevail
upon it to appeal with hia to Washington
for a decision whether or not it was a legis-
lature. The members mindful of the teach-
ings of tlto founders of the government of
our country true to their duty and to their
obligation to the people did no? entertain
ho proposition truth triumphed and error
was vanquished.
And in consequence the imposing fact
stands out in bold relief to-day;' that the
ofiiccrs of State are the representatives of
the intelligent taxpaying people -bfva!t
classes and color representativev-wh6
acknowledge their responsibility nhfc ferl
their accountability to their constituents
nn accountability that is the very essence M
Republican government' and without 1
which government is not republican. 1
Whenever the opposites of intelligence
integrity and property control in the affairs
of State and the cilices are filled by the
avaricious icnorant and vicious every de-
partment of Eociety feels the corrupting
degrading oppressive and destroyiog in-
fluence. - ". '
It would havo been as cravsn aud servile
in tho pcoplo of the South to have
"let politics alone." as it would be short-
sighted and consummate folly in them now
to forget that their States were conquered
and tho consequences that havo followed.
'Let politics alone 1" when' government
stamps the social moral and industrial
character of a community; when it elevates
or degrades sustainsor destroys a people?
Let us then Representatives ana legisla-
tors cast from us all prejudices passion and
resentment and rise to tho full measure of
our position. Let us swear at the altar of
our State that we will discharge our duty
our wholo duty and nothing but our duty
that wo will act with that deliberation and
forecast tint will contribute to making
Texas in government what she is by na-
ture tho greatest Btato in this Union. Let
us ctnulato the love and patriotic pride that
New Enjjlanders feel for their section.when
fhey look upon their Green Mountains gazo
upon Eodton Harbor or turn their ejes upon
tho monument ou Bunker Hill by culti-
vating love and pride for our own hills and
plainp our green bottoms and beautiful
prairies our Alamo and our San Jacinto!
Aye with all the ardor of devoted sonu let
us exclaim Texas now Texts forever one
and insrperable!

obeyed by States ns well as by the people

to making good government in its broadest

1. It ia hereby ordered by the Court that eacb person
appointed and acting as United btatea Commissioner

warrant iaaued by him with entries showing against
whom issued npon whose affidavit issued the time
when issued tho officer or person to whom delivered
for execution and time of delivery nature of offense
charged sad the names of the witnesses relied on to
sastain the charges which entries shall be made oo the
docket at the time the warrant ia issued. It is fanner
ordered by the Court that when persons arre ted un-
der Commissioners' warrants are carried bofore any of
the Commisbionera aforesaid cither for examination
or to give bond the actings and do-ngsof the Commis-
sioners and the date thereof shall also be entered on
said docket. And it ia furthermore ordered by the
Court that each Commisaioner aforesaid upon issu-
ing a warrant aud making the aforesaid entries upon
his docket or upon holding sn examination or admit
ting to bail as aforesaid ana msKing entry mcreoi
upon his docket xha.l forthwith make a report thereof
to the Clerk of the Circuit Conrt.- If the Commission-
er resides in a county embraced in that portion -of Ibis
Juriicial Distrletmsde returnable to Tyler me report
shall be trdnmitted to the Cleric at that place; if in
that part of the same returnable to Austin it shall be
transmuted to tne ciera: mere.
9. Whenever a warrant ehall be issued by a Commis
sioner for the arrest of any person it shall be made it-
tamable before him; proviaea no De tne uommisnoner
iiMrrtt or most convenient to the blace where the of-
fense wss commitied. If he is not. then he shall re
tain a certiiod copy of the affidavit on which the war
rant la issued and mate ine warrant accompanied oy
the original affidavit returnable before a Commissioner
acting in the county where tho offense was committed
or before a commi-siourr most convenient thereto
and such Commissioner shall make the examination of
the party and discharge commit to prison or admit
him to bail as the case may be.
8. Whenever any proceedings shnll be had before a
United states Commissioner touching the discharge
of a "'poor convict" aa provided by the fifteenth sec-
tion of the act ot Congress entitled '"An act to further
the administration of Justice" approved June 1 187J
such Comiuiasioner ahall forthwith make a report of
such proceedings to the VJrited fctates Attorney for
this District snd also to the DepartmeLt of Justice at
Washington City.
4. In arrests made under the Kevrsne Laws ef the
United States no Commissioner sht-11 receive any
money from the accused on a proposition to compro-
mise or for fees or for any other purpose. The powers
and duties of Commissioners ar defined by law and
their action must be con t cod strictly within its limits.
5. The Clerk of tbe United States Circuit Court at
Tyler is hereby directed to enter the foregoing orders
upon the minutes of eaid Conrt and transmit a cer-
tified copy thereof to the Clerk of the United States
Circuit Court at Austin for like entry there and also a
certified copy to each Coinmlss loner in their respective
Distrltts.
6. It is farther ordered that the Clerks aforesaid
cause these orders to be published for four weeks in
the Tyler Index and Austin Istatfpmaw.
