er channel arraigns us. If these are
not facts wc stand ready for correc-
tion. As to his deputjes as wo were writ-
ing of former abuses under which
the people groaned mid discussing gen-
eral principles it is enough to repeat

pointed and of whom we have hoard

mint!. On the contrary while know

never apply the term "understrapper"
to such young men and no man who
will read our article undorstaiidingly
in connection with the Kails county
case can so construe it.
So much as to the animus of our ar-
ticle. Those are simply tlio fnots and
ou that head we have no more to say.
Tho principle of law Involved is an-

to avoid arrest for sonic minor ollense. !
We have now the Kalis county
case presented by a grand jury tried
by "twelve good and lawful ineu" mi-
ller oath presided over by one of the
best district Judges in the stute thou
appealed to the supremo court argued
and unanimously ntllrmed. HV wc

subject however Is ono of grave im-
port and should he discussed calmly
with a solo view to the peace security
and good order of society.
As a general proposition an otllcer
certainly has no right to kill In order
to arrest. If so blot out government
and go hack into barbarism. The
right has been withheld we appre-
hend by the laws of every state In tho
union. Law-makers mid our ablest
statesmen have doomed it wise so to
order things. But extraordinary cases
as we said In our previous article do
arise In which a sound discretion for
the good of society must be lodged In
the otUeer'a breast. Kor Instance our
ehcrill to-day Is ordered to arrest a
man charged with some minor ofTence
punishable by Hue or imprisonment.
He nmy or may not be guilty. Of that
a sworn Jury is yet to lodge. To-mor-row
he Is ordered to arrest a notorious
desperado and murderer one Mho
may have killed several men and is a
terror to society. Xow common
souse experience and the
good of society all unite
lu saying that the sheriff as a capable
and discreet oOloer would approach
those men very (llllbreiiHy and while
under no probable circumstances short
of self-defense would he be justified
forsbootlng In the one case in the oth-
er case good men and sworn Jurors will
excuse him for shooting upon grounds
wholly untenable In ordinary arrests.
On this whole subject we had thought
