Commissioners Refuse
Changes in Courthouse
Completion Date, Cost
Newton County
Commissioners Court has met in
2 special sessions since the last
regular meeting, first on January
29 and again on February 6.
The agenda for both meetings
were quite abreviated. On
January 29 Commissioners met
to consider deliberate and con-
sider actions on documents
returning property to the
Montgomery heirs. The matter
was tabled for further discus-
sion. The Court also looked at a
resolution to endorse funding
request by Burke Center to the
Texas Department of State
Health Services to create an
Emergency Psychiatric Service
for the region.
Those 2 items plus continuing
education certification and pay-
ment of bills concluded the
meeting.
The February 6 special ses-
sion agenda dealt with a pro-
posed change order (#4) for the
Courthouse Restoration project
from architect Marcel Quimby.
Commissioners entered execu-
tive session for consultations
with District Attorney Misty
Weeks Spacek who acts as gen-

eral counsel for the Court on
matters concerning the
Courthouse Restoration project.
Commissioners returned to
open session and voted on
Change Order #4 which ,
according to District Attorney
Spacek, involves changes to the
construction contract in regards
to the installation of the court-
house’s mechanical (geother-
mal) system. As it was pro-
posed, C04 called for an addi-
tional $159,208 to be added to
the construction contract sum
and for an additional 116 days to
be added to the contract time
(pushing back the substantial
completion date of the court-
house to February 10, 2009).
District Attorney Spacek indi-
cated that, after considering the
proposed change order, the
Commissioner’s Court declined
agreeing to the changes in the
contract sum and time at this
time. Instead, the Court voted to
request that architect Marcele
Quimby issue a Construction
Change Directive, ordering
installation of the mechanical
system without an agreement on
additional time or money.~“
The Toledo Bend Women's Association, represented by Betty
Nesbit, took this opportunity to present to the Toledo Bend
Community Club Chairman, Douglas Dees, a check in the
amount of $3,00.00 to be used by the Community Club for
expenses and needed building repairs for the 2008 calendar
year. The Toledo Bend Women's Association serves as the
fund-raising arm for the Community Club by hosting monthly
Soup Lunches, cookbook and calendar sales as well as special
dinner and bake sales. The TBWA also presents an annual schol-
arship to a Burkeville Senior each year.
The Toledo Bend Community Club honored Charlotte
Brockette, Chairman and members of her Telephone
Committee by presenting them with floral bouquets. The
