has just been decided in tne Cheboygan circuit
court. Last spring John M. Nelson entered into
a contract with log owners to pick up and saw
deadhead logs taken from the Cheboygan and
Black rivers. Meantime at the October session
of the board of supervisors a contract was enter
ed into with Gainor & Storms conveying to them
all the deadheads in the streams named on condl
tion that the}- should cleat the streams within
three years of not only sunken logs but snag s
and other obstacles to inland navigation.
This contract was made despite the protest ot
log owners who had contracted with Nelson to
remove and saw the deadheads. Then Gainor <&
Storms obtained an injunction restraining M r.
Nelson trom removing any logs or deadheads in
the rivers named, Uns being subsequently modi*
fled to perimt him to pick up his own logs on giv-
ing a oond for $5,000. Later the attorneys ot
Nelson tiled a demurrer to the bill of complaint
and the hearing was upon this. The court sus->
talned the demurrrer and dismissed the bill ot
complaint, holding that the statute did not at
tempt to confer such power on the boar land had
it done so it would Rave been uncou.-^titutiona I,
and tbeboard of supervisors having exceeded its
authority the contract with Gainor &• Storm was
void.

consider the following advances over the Decem-
ber 27 list about the proper values for southern
pine at this tune: A, B and C edge grain flooring ,
$1.25 a thousand, all other flooring fl; all ceiling
and partition. $1; siding and finish, 7r> cents:
molded casing and base and jambs, #1; boards
and sbiplap, $1.50; fencing,$1.25; No. 1 dimension
22 and 24 fret, $1.50, other lengths $1; No. 2
dimension, $1; heavy joists, $2.25; timbers, $1.50,
Byrkit lath,*75 cents; :l-8 inch lath, 25 cents.
Many of the manufacturers here are getting out
Dew lists; these are not uoiform and do not cor
respond with the foregoing ad vauyes. Several of
the larger concers have not had their men on the
road since the first of the year and claim that
they are getting more unsolicited business than
they want. Shipments are lreer than they have
been, but the demand to date has uroken all
records for the first sixty days ot the year and
the yellow pine mills will average fully lorty tive
days behind their orders on yard stock and any
where from sixty days to six months behind on
tailroad and car raateiial.
The Luteller & Moore Lumber
docks have presented a busy, scene this week,
owing to the {large water shipments they are
making. The schooner Davenport, under’char
te- to this company to take a^cargoof lumber |||
from Sabine Pass to acw York, is now due at
the loading port *and her cargo is being gotten
ready, the barges .Cuba and Nicaragua .being
loaded with material for that purpose.
The Texas Nigger Bar company’s factory at
[Orange is now busily engaged in turning out
these famous bars, which are rapidly making a
reputation wherever they are introduced. A
recent issueof the American Lumberman contain-
ed an interesting description of this bar, which
was invented by D. R. Edwards, of Orange, and
is manufactured by him at th! s place. '

The current issueof the American Lumberman
contains the following review-of southern pine
conditions, as reported from some of the leading
maikets, and fairly represents conditions in this
territory?
St, Louis, Mo. The situation ha§<grown even
firmer. Many individual inanulacturers have
issued private lists which show advances ove
the December list ot the Yellow Pine Manufac-
turers’ Association ot trom f 1 to $£ a thousand.
[The rightband sideot the list has advanced pro
portionately more than the letthand side. Num-
bers 1 and 2 common boards are bringing from $1
to (1.50 more than in December. Both No. 1 and
No. 2 common dimension is selling freely at $1 to
$-4.50 above December figures Timbers, joists
and special stock will Sring almost any price
within reason where promp1 delivery can be
made. Ail grades ot edge grain flooring are
| scarce and are bringing from $1 to $2 above the
December list. Partition is another item which
! is in short supply and long demand.
Chicago.—Mill representatives in this terri-
tory are dodging orders rather than seeking them,
as their mills are reported to be so heavily filled
up that they are unable to accept further orders
for many Items at present. Howeter there is
considerable being done In |tbe way of finishing
lumber and dressed yard {stock, although great
difficulty is experienced in securing cars and in
getting the lumber forward promptly. There is

W. H. Stark, general manager of the Lutcb<
& Moore Lumber company, spent a day in Hous-1
ton this week, giving evidence in the hearing
now in progress before the master in chancery 13
regarding the controversy between the Houston
Oil company and the Kirby Lumber company
over the timber being cut by the latter. ,1

Another ot the big mills of the Loag-Bellf
Lumber company was destroyed by fire this
week, their plant at Woodworth, La., known as
the Rapides Lumber-company, having gone tip
in smoke several days ago.
A. O. Stewart, formerly sawyer for the D. G.
Petty Lumber company at Boleyn. La., has
returned to Orange and jhas accepted a position
as salesman in the mill supply department ot the
Anderson Hardware company, _

The Miller-Link Lumber company loaded the
barge Carl this week and seat her to Port Arthur
her cargo consisting of ties for the Mexican
Central railroad and some heavy timbers for the
Texas company. .

The barges Sabine, Perry and Mexico are being
loaded by the Lutcher A Moore Lumber company
this week with material for shipment to Mexico.
It will go out from Port Arthur on one
vessels of the Mexican-American steamship line.
