MISSION of the City of Weather-
ford, determining the necessity of
levying an assessment against the
property and the owners thereof abut-
ting upon Palo Pinto from the west
property line of the public square to
the west property line of Lamar;
<South Main street from the south
property line of the public square to
the south property line of Lee Ave.;
Fort Worth from the east property
line of the public square to the main
line of the Gulf, Colorado and Santa
?e railway! North Main from the
(north property line of the public
-square to the Texas and Pacific Rail-
way; York Avenue from the north
property Ijine of the public square to
the main line Gulf Colored* and Santa

west on Dallas, and the Public Square
in the City of Weatherford, Texas,
»nd aganist the steam railway com-
pany or companies whose tracks oc-
cupy any of said streets, fixing a Itme
for the hearing of the owners of 6aid
property, and the said steam railway
company or companies concerning the
same, and directing the City Secretary
to, give notice of said hearing as re-
quired by the ordinances and city
charter of the City of Weatherford:
Whereas, the City Commisison of
the City of Weaterford has heretofore
by resolution ordered the improve-
ment of Palo Pinto from the west
property line of the public square to
ton, Texas; and,
Whereas, the Henry Exall Elrod
Company, consulting engineers, have,
South Main from the south property in accordance with the ordinances
North Main from the north property
line of the public square to the south
property line of Lee Ave.; Fort Worth
from the east property line of the
public square to the main line of the
Gulf, Colorado and. Santa Fe Railway;
line ’of the public square to the Texas
and Pacific Railway; York avenue
from the north property line of
the public square to the main
line Gulf Colorado and Santa Fe Rail-
way; Spring from east property line
of York to the west property line of
North Main; West Dallas from west
property line of the public square west
on Dallas, and the public square in
he City of Weatherford, Texas, by
filling, grading, raising and paving the
oame with Willite paving, and the buil-
ding of curbs on either side of said
streets and said public square named,
when found necessary, and by the
construction of necessary drains and
storm sewers under and along said
streets and said public square, when
found necessary, in accordance with
the terms of said resolution; and,
Whereas, in accordance with the
ordinances and city charter, after ad-
vertising for bids, the said work of
improving said streets and said public
square between the said points above
named has been let to Texas Willite
Road Construction Company of Hous-
and the city charter of the said City
of Weatherford, filed the report with
the City Commission as to the cost of
said improvements and as to the other
matters required by the ordinancess
and the city charter;
Now, therefore, be it resolved by
the City Commission of the City of
Weatherford:
That' the said report or statement
filed by the said Henry Exall Elrod
Company, consulting engineers, hav-
ing been duly examined, is hereby ap-
proved, and
Be it further resolved, that part of
the cost of said improvement shall be
assessed against the abutting prop-
erty upon the streets and public
square named to be improved and the
owners thereof, and that the total cost
of the said improvement shall be paid
and defrayed as follows:
(a) That the City of Weatherford
shall pay an amount equal to the total
cost of improving the intersections of
said streets, and the public square
named to be improved with other
streets and alleys, except such por-
tions as are occupied by the rails and
tracks of the steam railway company
or companies, and between the same
and two feet on the outside thereof;
and the City of Weatherford shall also
pay an amount equal to one-fourth of
the total coat of improving said streets
and public square named to be im-
proved, between the interesections of
cross streets and alleys;
(b> -hat the steam railway com-
pany or eompaneis shall pay the cost
of said improvements in all portions
of the said streets where the tracks
of the said company or companies ex-
ist ani tor two feet on either side
theret t; and where the same is dou-
ble tr. i ked, the same shall be paid
by th said company or companies for
that portion of street lying between
their tracks and rails and for two feet
on either side thereof;
(c) That after deducting the pro-
portion of the cost provided for in
subsections (a) and (b) above, the
total remaining costs of such improve-
ments shall be paid by the_owners of
the propehy abutting upon sadi streets
and public square named to be im-
proved, in the following manner: The
owners of the property abutting ufion
said streets and the public square
named to be improved shall pay the
whole cost of installing concrete curbs
in front of their respective properties;
and an amount equal to three-fourths
of the whole cost of all their improve-
ments shall be paid by the said prop-
erty owners, and shall also be assess-
ed against them and their respective
parcels of land abutting upon said
streets and said public square, named
to be improved; and said as'hessments
shall be made in accordance with.
and subject to, the charter and ordin- Company,
ances of the City of Weatherford, and|tofore and
after-the hearing herein mentioned,
against the owners of the property
abutting upon said Streets and the
public square to be improved, and
their property; that the cost which
may be assessed against such proper-
ty or its owner, shall be in accordance
with the “front foot plan” in propor-
tion as the frontage of the property
of each owner is to the total frontage
of the property on said streets and the.
public square named to be improved,
but that no assessment shall be made
against any of said proparty, or its
owners, in excess of special benefits
in enhanced value to said property
caused by said improvement, nor un-
til after the hearing hereinafter meh-
tioned.
That the part of the said cost to bo
paid by the said property owners ai)d
assessed against them and their prop-
erty abutting upon said street shall
be pjayable in three equal install-
ments; the first payable in thirty days
after the final completion and accept-
ance of the work by the city; one on
or before one year from said date, and
one on or before two years from said
date, with interest at 8 per cent per
annum, provided that any property
owner may pay, before maturity by
paymeqt of principal and-accrued in-
terest; and,
Whereas, according to the report cr

ed, that a hearing shall be given to
the said owners, or their agents or
attorneys, and all persons interested
in the said matter, as to said assess-
ments, and as to the amount to be
assessed against each owner and his
property and as to the benefits to said
property from, said improvements, or
any other matter or thing in connec-
tion herewith, and to the said, steam
railway company or companies as to
said assessment and as to the amount
to be assessed against each such com-
pany and its property and all matters
