Give Bullock a helping hand
^"\bVIOUSLY DISGUSTED with inter-
^^^ference by the courts in the legislative
processes in Texas, Lt. Governor Bob Bullock
demanded last week that the people of Texas be
allowed to vote on a plan for public school finance
in the form of a Constitutional Amendment
which could not be open to court challenge as
un-constitutional.
Bullock is certainly right on that score. If the
people approve an amendment to the Constitu-
tion incorporating a plan for school finance, the
plan would be, per se, constitutional. But first
there must be a plan, and that must come from
the Legislature. There is the problem.
The plans so far proposed by the Legislature
have not met with approval of either the courts
or the people. If our legislators can rise for a
moment above personal political prejudices and
come up with a school finance plan which is both
adequate fiscally and acceptable philosophically
to a majority of Texans, there is reason to believe
that it might be adopted as a part of the State
Constitution and would be judgement-proof at
least from the machinations of the State courts.
That is admittedly a large order, but surely it is
not an impossible one.
It may be impossible for the State Legislature,
as presently formed, to produce such a plan
through its normal processes. So far it has been,
certainly...so extraordinary measures may be in
order. That is an area where leadership is
needed, and Bullock is the man who just might
be able to pull it off.
A really "select" committee, which must in-
clude representatives from the Senate and
House but should also draw from leaders in busi-
ness and education, could be formed and charged
with producing a plan for the Legislature to
consider presenting, if necessary, to the people of
Texas for a vote. If that is Bullock’s strategy, he
should be able to muster the political clout to
make it happen. If anybody in the political
leadership can do it, the Lieutenant Governor
can.
That, it appears to us, is our best hope. The
Legislature itself hasn’t been able to produce a
workable plan, and probably can’t now...but if
confronted with a carefully-constructed plan it
might be able to agree to present it to the people.
That shouldn’t be necessary...the Legislature
is charged with the responsibility, and is given
the power, to write the laws...but it hasn’t been
able to get the job done and in the face of the
adversarial power of the politically-dominated
state courts, it may not be able to do it without a
vote of the people on an enabling amendment to
the Constitution which would short-circuit the
Court system.
We urgently need to break this logjam, and
surely we have brains enough among the citizens
of this state to develop a plan which will be
equitable and legal. Maybe going back to the old
Minimum Foundation Fund established by the
Gilmer-Aiken legislation of the late 1940s would
be the place to start. It was a major step in the
right direction at its inception, but was never
adequately financed. Certainly state-wide
financed support of the public school system is
needed if Texas schools are to approach the ideal
of equal educational opportunity, but it must not
be done at the expense of "home rule" over the
day-to-day operation of the local school districts.
The goal of providing for an adequate public
school system in Texas, with equitable state-
wide distribution of the cost while protecting the
autonomy of the local boards who are closest to
the problems and most knowledgeable about the
needs of their communities, is surely not impos-
sible to meet. But it will require a meeting of the
best minds in the state, and they are not to be
found in the Legislature itself.
We have high regard for the ability and good
sense of the Lieutenant Governor, and hope Bob
Bullock can pull it off. Give him a helping hand
