While one trial for an
alleged sex predator is
postponed, another for an
alleged murder is pending
for April 21.
The District Attorney’s
Office is preparing to try a
capital murder case against
Joshua Dewayne Ragston.
The now 22-year-old,
along with fellow Hemp-
stead resident, Christopher
Boulds, now 28, were in-
dicted for the July 17, 2009
capital murder of Navasota
Stolz liquor store owner,
Don Stolz, in 2012. Stolz
was shot to death at his
store in broad daylight dur-
ing an apparent robbery.
After a three-year wait,
the high-profile case ended
in both arrests after Boulds
made a 911 call that report-
SPRING
edly revealed his involve-
ment in the murder, as well
as Ragston’s.
June 25, 2012, just three
days after the arrests of
both men, the Supreme
Court banned mandatory
life without parole (Miller
vs. Alabama). District At-
torney Tuck McLain said
that meant Ragston - who
was 17 when the alleged
capital murder occurred -
would only be able to be
tried for the lesser charge
for murder and aggravated
robbery.
Last year, McLain and
the victim’s son helped
enact Senate Bill 23 (SB
23), which allows a 17-
year-old to stand trial for
capital murder, and in-
cludes a sentencing choice
of either life with parole
after 40 years, or life with-
out parole.
A pretrial hearing is
slated for this Friday. As-
sistant District Attorney
Andria Bender said the
murder trial will take first
priority, over three others
on the docket, and is tenta-
tively set for April 21.
Meanwhile, a pretrial
hearing, related to a mo-
tion to revoke probation
for Kerri Elizabeth Ward
Hilley of Navasota, 32,
ended in postponement of
an April 11 bench trial.
Hilley was initially
charged with and indicted
for 26 counts of second-de-
gree felony charges for
sexual assault of a child -
that each carry a possible
prison sentence of up to 20
years - related to two dif-
ferent male victims, and
received a plea agreement
that included one single
charge of injury to a child
on Oct. 4, 2010.
The plea agreement also
included dismissal of nine
counts of furnishing alco-
hol to a minor, a Class A
misdemeanor. Both male
victims were allegedly the
recipients of the alcohol, as
well as six other males and
females.
The injury to a child
charge, a third-degree
felony, carries a possible
prison sentence of up to 10
years. But Hilley instead
received deferred adjudica-
tion and probation for five
years, and also does not
have to register as a sex of-
fender.
McLain said he made
the plea agreement after al-
leged victims refused to
cooperate.
Oct. 18, Hilley was ar-
rested for allegedly violat-
ing her probation, four
different ways, for a total
of eight violations.
Bender said Hilley’s
hearing was reset for June
13, since the defense attor-
ney had a scheduling con-
flict for the April 11
docket.
“We had five total mo-
tions to revoke, set for the
same settings. Three out of
the five were rescheduled,
including Ms. Hilley’s, due
to motion for continuance
by defense counsel, due to
vacation letters and/or
scheduling conflicts,” Ben-
der said.
