tion. Tho committee which prepared it and particularly Mr.
Mallard by whom that labor wo are told wns principally per-
formed deserve great praise for the care with which they have
performed tho duty devolving upon them. Tho interest which
overy person feels in having a good probate law is our excuse
for giving somewhat in detail tho various changes effected by
this bill in tho old law.
Many of tho provisions of tho old law have been retained with
but littlo alteration but whero this has been done tho matter
has been carefully digested and arranged under their appropri-
ate heads in a manner that greatly facilitates tho reader in
finding and comprehending tlio divisions of the subject. One
material change is in regard to tho appointment of Administra-
tors giro tern. which will save much oftlio cost attendant upon
such appointments. Administrators are permitted to sell per-
ishable property under certain regulations without obtaining
tin order of tho court and other property not exceeding a spe
cified amount for the payment of debts under rules prescribed
without putting tho estate to tho expense of obtaining a previ
ous order Of court. Tho rules relating to tlio payment of debts
duo by the estate nreinuch simplified; the executor or admin-
istrator being required to settle them without tho vexatious
delays and expenses of procuring tho several intervening or-
ders required by tho existing laws. As in tho old law ad-
ministrations may bo closed at the expiration of twelvemonths.
At tho term ofthp court when notice is given that the executor
or administrator will present his account for final settlement
tho bill provides that the heirs devisees or legatees Bhall bo
citetl to appear whereas; tho existing law seems to contemplate
(and is so practiced) first notice to creditors to attend the set-
tlement' and then at a succeeding term notice to heirs &c
to attend tho partition and distribution of the estate a prac-
tice which accumulates much unnecessary costsX
A summary method of settling small estates is provided for
by which comparatively small" expense is incurred.v Forms
are appended to the bill which will onablo executors andid-
miniBtrators whero tho affairs of tho estate are not complicated
to prepare their own petitions exhibits and accounts for settle-
ment. It is provided that the law if passed shall be' printed
in sonarato pamphlet form and be distributed to tho several
counties in' order that it may bo accessible .to all. This act
seems to us to bo free of much of the complication complained
of in 'the old Probate law aiid its being about one-third shorter
than its predecessor is notits leastreconiiiiendation. The addi-
tional powers conferred on administrators guarded as they
are will not be unsafe to estates while at least two-fifths of the
usual expense attending their settlement will unquestionably
bo saved.
'Tho Legislature have been ' legislating about railroads so
much that they have caught the go-ahead principle and are
progressing with business with a rapidity that tho swiftest loco-
motive might well envy. Under such circumstances it is im-
possible to give anything like a full summary of theirprocoed-
ings. In a few days wo will try and pricuro for publication
the captions of all tho general laws and such of the special
laws as arc of general interest and lay it before our readers.
