STRUCTION OF BRIDGES AND
THE MAINTENANCE AND OPER-
ATION OF PUBLIC WAREHOUS-
ES.
(S. J. R. No. 18.) Senate Joint Resolu-
% tion.
To be entitled A Joint Resolution
proposing and submitting to a vote
of the people of Texas an amend-
ment to Sections 49 and 52 of Arti-
cle 3 of the Constitution, authoriz-
ing the issuance of bonds and the
’ levying of a tax to pay the interest
and sinking fund on same for public
improvements.
Be it resolved by the Legislature of
the State of Texas:
Section 1. That Sections 49 and
53 of Article 3 of the Constitution of
• Texas be amended so as to hereaf-
ter read as follows, to-wit:
Section 49. No debt shall be creat-
ed by or on behalf of the State ex-
cept to supply casual deficiencies of
revenue, repel invasion, suppress in-
surrection and defend the State in
war or pay existing debts, and .no debt
Created to supply deficiencies in cur-
rent revenues shall ever exceed in the
aggregating at any one time five hun-
dred thousand dollars. The Legisla-
ture, however, shall have t power to
authorize the issuance of bonds to be
approved by the Governor for the pur-
pose of purchasing additional ground
and erect necessary buildings for the
University of Texas, including a med-
ical department, an Agricultural and
Mechanical College and all depart-
ments and activities of a complete
university of the first class. The rev-
enue received from the permanent
University fund shall be available for
the payment of interest oif these
bonds and for the creation of a sink-
ing fund for their redemption at ma-
turity and the Legislature shall also
have power to issue bonds for the con-
struction of necessary buildings for
State institutions.'. The Legislature
shall also have the power to authorize
the issuance of bonus secured by lien
oU the real property of the penitenti-
ary system to be approved by the Gov-
ernor for the purpose of constructing
buildings and making permanent im-
provements.
Section 52. The Legislature shall
have no power to authorize any coun-
ty,. city, town or other political corpo-
ration or subdivision of the State to
lend its credit or to grant public mon-
ey or thing of value in aid of or to
any individual association or corpo-
ration whatsoever or to become a
stockholder in such corporation, as-
sociation or company; provided, how-
ever, that under Legislature provis-
ions any county, any political subdi-
vision of a county, any number of ad-
joining counties or any political sub-
division of the Stale or afiy defined
district now or hereafter to be de-‘
scribed and defined within the State
of Texas and which may or may not
include towns, villages or municipal
corporations upon a vote of a majori-
ty of the resident property taxpayers
Voting thereon who are qualified elec-
tors of such district or territory to be
effected thereby in addition to all
other debts may Issue bonds or other-
wise lend its credit in any amount not
to exceed one-fourth of the assessed
valuation of the real property of such
district or territory, except in case
of improvement of rivers, creeks, and
streams, in buildings, in building of
levees to prevent overflows, in which
case the bonded indebtedness may be
for an amount not to exceed one-half
of the assessed valuation of the lands
«t the district to be reclaimed; and,
-except, further that the total bonded
indebtedness of any city or town shall
never exceed the limits imposed by
-other provisions of this Constitution^
and levy and collect such taxes to pa?'
the interest thereon and provide a
winking fund for the redemption there-
of as the legislature may authorize
and in such manner as it may author-
lie the same for the following pur-
poses, to-wit: ;
(a) Tile improvement of rivers,
, creeks, and streams to prevent over-
flows, and to permit of navigation
thereof or Irrigation therefrom or in
aid of such purposes.
(b) The construction and mainte-
nance of pools, lakes, reservoirs, dams
-canals and water-ways for the purposes
of irrigation, drainage or navigation
of in aid thereof.
(c) The construction, maintenance
and operation of bridges and macad-
amized, graveled, sandy clay, or clay-
ed sand or paved roads and turnpikes
or in aid thereof.
(d) The construction, maintenance
and operation of pubic warehouses or
in aid thereof.
Sec. 2. The foregoing amendment
to Sections 49 and 52 of Article 3 of
s the Constitution of Texas shall be sub-
mitted to the qualified electors of
this State for adoption or rejection at
a special Election hereby ordered for
the third Saturday in July, 1913, the
same being the nineteenth day of said
month. All voters on this proposed
^ amendment at said election who favor
its adoption shall have printed or
written on their ballots the following:
For amendment to Sections 49 and
52 of Article 3, of the Constitution,
authorizing the issuance of bonds for
the University of Texas, Agricultural
and Mechanical College, State Peni-
tentiary System, and other public im-
provements and building of ware-
houses for agricultural products.
Those voting against its adoption
shall hive written or printed on their
ballots the following:
Against amendment to Sections 49
and 52, of Article 3, of the Constitu-
tion, authorizing the issuance of
bonds for the University of Texas,
Agricultural and Mechanical College,
State Penitentiary System, and other
public improvements and building of
* warehouses for agricultural prod-
uct*.
Previous to the election the Secre-
tary of State shall cause to be printed

and forwarded to the County Judge of
each county, for use, in said election,
a sufficient number of ballots for the
use of voters in each county on which
he shall have printed the form of the
ballot herein prescribed, for the con-
venient use of the voters.
Sec. 3. The Governor of the State is
hereby directed to issue his neces-
sary proclamation ordering this elec-
tion, and have same published as re-
quired by the Constitution and laws of
the State. The sum of five thousand
(35,000) dollars, or so much thereof
as may be necessary is hereby appro-
priated out of i%ny fund in the State
Treasury not otherwise appropriated
to defray the expenses of publishing
said proclamation and printing of
tickets and necessary blanks to he
used in said election.

Amending Section 7, Article 5, of the
Constitution of the State of Texas,
relating to the creation and forma-
tion of judicial districts, the terms
of comppnsatlbn and qualification
of the judges of the district courts,
and the times of holding court.
Be it resolved by the Legislature of
the State of Texas:
Section 1. That. Section 7, Article
5, be amended so as to hereafter read
as follows:
Section 7. The State shall be divid-
ed into as many judicial districts as
may now or hereafter be provided by
law, which may be increased or dim-
inished by law. For each district
there shall be elected by the qualified
voters thereof, at a general election,
one or more judges, each of whom
shall be a citizen of the United States
and of this State, who shall have been
a practicing lawyer of this State, or a
judge of a court in this State for six
years next preceding his election; who
shall have resided In the district in
which he was elected . for two years
next preceding his election; who shall
reside in his district during his term
of office; who shall hold his office
for a period of four years, and shall
receive for his services an annual sal-
ary of three thousand dollars, until
otherwise changed by law. Court shall
be held by a district judge at the
county seat in each of the several
counties at such times and in such
manner as may be prescribed by law.
The Legislature shall provide for the
holding of the district court when the
judge thereof Is absent, disabled or
disqualified from acting. The district
judges who may be in office when
this amendment takes effect shall

the amendment of Section 7, Article
5, of the Constitution of the State of
Texas, relating to district judges and
district courts.”
Sec. 3. The sum of five thousand
dollars or so much thereof as may be
necessary Is hereby appropriated to
pay expenses for carrying out the pro-
visions of this resolution.

Of the Legislature of the State of
Texas, proposing an amendment to
the Constitution of the State by
adding to Article 16 thereof a new
section to be known as Section 58,
providing for the tenure and com-
pensation of public officials.
Be it resolved by the Legislature of
the 8tate of Texas:
Section 1. That there be added to
Article 16 of the Constitution of the
State of Texas a new section to be
known as Section 58, which shall read
as follows:
Section 58. All S,tate, district,
county and precinct officers within
the State of Texas shall hereinafter
be compensated by the payment of a
salary to be fixed or provided for by
the Legislature.
Sec. 2. The Governor of this State
will, as directed by the Constitution,
make publication of this proposed
amendment in the manner and for
the time as required by the Constitu-
tion, the amendment to be voted upon
by the qualified electors for members
of the Legislature of this State at the
general election to be held for State
officers on July 19, 1913, the returns
of which shall, as provided for in the
Constitution, be made to the Secre-
tary of State, the result ascertained
and proclamation made as provided
for In Section 1, Article 17, of the Con-
stitution. There shall be written or
printed on the ballots to be used at
such election “for fhe adoption of Sec-
tion 58, Article 16, ?s an amendment
to the Constitution, providing a salary
compensation for certain Officers and
fixing term of office at four years;’
and also “against the adoption of Sec-
tion 58, Article 16, as an amendment
to the Constitution for certain officers
and fixing their term of office at
four years;” and those favoring the
adoption of said amendment shall
erase the language “Against the adop-
tion of Section 58, Article 16, as
an amendment to the Constitution,

A Joint Resolution proposing an
amendment to Section 52, of Article
3, of the Constitution of this State:
Section 1. Be It resolved by the
Legislature of the State of Texas, that
Section 52 of Article 3, of the Consti-
tution of the State of Texas, be amend-
ed so as to hereafter read as fol-
lows : ?
Section 52. The Legislature shall
have no power to authorize any coun-
ty, city town or other political cor-
poration or subdivision of the State,
to lend its credit or to grant public
money or thing of value in aid of, or
to any individual, association or cor-
poration whatsoever, or to become a
stockholder in such corporation, asso-
ciation or company, provided, how-
ever, that under legislative provision

of the State, or any defned district
now or hereafter to be described and
defined within the State of Texas, and
which may or may not include towns,

upon a vote of a majority of the resi-

or territory to be affected thereby, in
addition to all other debts may Issue
bonds or otherwise lend its credit in
any amount not to exceed one-fourth

property of such district or territory,
except that the total bonded indebted-
ness of any city or town shall never
exceed the limits imposed by other
provisions of this Constitution, and
levy and collect taxes to pay the in-
terest thereon, and provide a sinking
fund for the redemption thereof, as
the Legislature may authorize, and
in such manner as It may authorize
the same, for the following purposes,
to-wit:
(a) The improvement of rivers,
creeks and streams to prevent over-
flows, and to permit of navigation
thereof, or irrigation thereof, or in
aid of such purposes.
) The construction and mainte-
nance of pools, lakes* reservoirs,
dams, canals and water-ways for the
purposes of irrigation or in aid there-

(c) The construction, maintenance
and operation of macadamized, grav-
eled or paved roads, and turnpikes, or
in aid thereof. '

for storing, handling, classing, meas-
uring, weighing, elevating and load-
ing agricultural products. Provided
the Legislature may establish such
means and agencies as may be neces-
sary for accomplishing the purpose of
this amendment and if a State ware-
house commission be provided for,
their term of office shall be fixed by
the Legislature. '
Sec. 2. The Governor is hereby di-
rected t6 issue the necessary procla-
mation for submitting this amend-
ment to the Constitution to the qual-
ified electors of the State of Texas
on the third Saturday in July, same
being the 19th day of said month, and
the amendments proposed to Section
52 of Article 3. as above Indicated,
Bhall be voted upon separately.
Those favoring the amendment to
authorize road or other public im-
provements by a majority vote, shall
have written or printed on their bal-
lot: For amendment to authorize
road and other public improvements
by a vote of a majority, and those op-
posed to said amendment shall have
written or printed on their ballot:
Against amendment to authorize road
and other public Improvements by a
vote of a majority.
Those favoring the issuance of
bonds for the construction of public
warehouses shall have written or
printed on their ballot: For the amend-
ment authorizing the issuance of
bonds for the construction of public
warehouses for agricultural products.
Those voting against said amendment
shall have written or printed on their
ballot: Against the amendment au-
thorizing the issuance of bonds for the
construction of public warehouses for
agricultural products.
Sec. 3. The sum of five thousand
($5,000) dollars or so much thereof as
man be necessariy, is hereby appro-
priated out of any funds in |he Treas-
ury of the State of Texas, not other-
wise appropriated, to pay the expenses
of such publication, proclamation and
election.
