OPMON DECURES
PENALTY LAW VOID
Assessments Cannot Be Lev-
ied Prior to January 31,
1921.
Austin, Tex.—The attorney general's
department In an opinion to Repre-
sentative Met eon. held that legislation
rnteealng and relinquishing penalties
already Incurred by taxpayers for fail-
lire to pay taxes prior to Jan. 11.
1M1, would be void "becauae It con
travenes section 55. article 8. and sec-
tion 10. article 8 of tbe constitution
•f Texas. '
However, the opinion says: "A post-
ponement of the payment of penalties
already incurred would not be a re-
leasing nr rBllRonlshUitr’ of an obliga-
tion or liability which is Inhibited by
the constitution."
Tha affect ef the opinion is that
the bill recently passed by both
branches of the legislature, and signed
by the governor, which la to become
effective ninety days after adjourn-
ment pf tho legislature, is unconstitu-
tional so far as It seeks to reduce
tbe penalties from 10 per cent to 5
per-cent tor the period from Feb. 1,
