2 Wo recommend that a committee of
threo ho appointed by the chairman to bo
known as ommittco No 1 to whom shall
be referred all proposed changes and amend-
ments to tho penal code and a like commit-
tee to be known as committee No to
whom shall bo referred all proposed changes
and amendments to the code of criminal pro-
cedure whose duties it shall bo to pass
upon such proposed changes and repor tho
samo to this convention with their recom-
mendations thereon
We further recommend that a commit-
tee of three be appointed by tho chair to bo
known as a committeo on resolution to
whom shall Iks submitted all resolutions not
coming w ithin the power herein recommen-
ded for the former two committees
We further lccommcnd that 10 a m to-
morrow be set as the time to hear the ad-
dress of welcomo by the Hon T J Powell
and that J T Buie be appointed by the
convention to respond and that tho public
bo cordially invited to attend

J he report of tho committee was unani-
mously adopted and on motion a committee
was appointed to conduct tho permanent of-
ficers to their respective stations Mr
Myers the permanent chairman of the con-
tention is a young man of more than or-
dinary abilitv and halls from John-
son county Though considerably younger
than some of his associates he seemed to
have their confidence as to his ability to
presido ocr the important deliberations of
the body He is over six feet two inches
high with light hair and complexion and a
clean shaven face dchberato in his utter-
ances and decisive i his rulings
I poit taking the chair he made
a few remarks in further explaining tho
purposes lor which the convention was
called
Gentlemen of the Comention
I thank jou for the honor that you have
coufeired on me m selecting mo as jour

It would perhaps bo not amiss forme to
statu some of the causes necessitating this
convention There is a general impression
among the people that the penal laws of
this state are not enforced as they should
be that tho oriuimals are escaping
iuuishment that justico too often
miscarrns and thit the courts

and juries are no longer to
be relied upon bj which to sustain the
rights of the people The nowspapers and
especially may I mention the Fort Worth
Gazette and the Dallas News are daily
and weekly parading before the eyes of the
reading public these facts It has also
been said bj a leading law writer that
he penal code and code of criminal
procedure of Texas are spotted all over with
linger marks of lawyers who make their
living by defending persons accused ol
crime I do not admit the truth of these
charges but I do say that something some-
where is radically wrong and that it is our
duty as eonscientious officers of the peo-
ple Cf find where the defect is
if in our power remedv
it If it be in the law itself certainly by
constant observation research and experi-
ence in attempting to enforce the law we
oueht to be able to find wherein tho law is
deficient and if we can It is our duty as
officers of the people intrusted with the en-
forcement of the law to use every effort
within our power to cure the defect If it
bo not in the law bnt because
of a failure on tho part of the people at
large including the courts and the juries
tousothemeansatourdisposal in enforc-
ing tho law then it would devolveupon us
to discover the proper manner to proceed
There is certainly a causo somewhere and
we should make an honest endeavor to find
it It Is Indeed a sad reflection upon
the intelligence of the people of
this state to say that they
the citizens have not confidence in the
efficiency of the courts to protect the rights
of the citizen In order to enforce any law
made for the protection of the rights and
liberties of tho citizen it is necessarj for
those attempting its enforcement to have
tho full moral support ot every citizen
If this contention fails to make
any suggestion as to the amend-
ment or change of the laws worthy
of adoption I still have hopes that it will
have a tendencj to cause the people to give
their officers their full and unqualified
moral support Let us then with the
nature of our work fully before us
all tho timet enter upon tho
discharge
of our labors in this convention with the
single view of encouraging the repeal cf all
bad laws the passage of good ones and the
strict and rigid enforcement thereof Again
let me thank jou for the distinguished
honor conferred on me
Professor Carlisle of the high school then
asked the privilege of the floor and re-
quested that in addition to at-
tending the entertainment of the
state normal the attorneys appoint
one of their number to address the mem-
bers of the normal at the university last
night Professor Carlisle was assured that
the invitation of tho normal would be com-
plied with and later in the atfernoon
after numerous nominations and as many
declinations of the honor J C George was
elected to deliver the addi ess
A motion that a committee of three
be appointed for the purpose of making
the convention of district and county
attorneys a permanent organization was
made As a substitute it was moved that
this come under the province of tho com-
mittee on resolutions and that this commit-
tee should fix the time and
place of the next meeting decide
on dues initiation fees etc and draft a con-
stitution and bylaws for the govern-
ment of the conventions which
shall hereafter assemble The sub
stituto was adopted after which
tho reading of resolutions and proposed re-
visions of tho penal code and eodo of crim-
inal procedure was begun
Tho following were the mo3t important
resolutions offered
Resolved that the legislature be asked to
limit or confine tho testimony of a defend
ant in his own behalf as follows If a de
feudant be allowed to testify at all ho be
compelled to testifj first as a witness for
tho defense and not afterward Another
resolution of the same purport was offered
Resolved that article CS5 of the Code of
Criminal Procedure be repealed
Resolved that in caso of seductionwhere
tho defendant promises to marrj tho plaint-
iff and to so pain a dismissal of the suit
that it shall lie the duty of the jury to sat-
isfy itself of the good faith of the promise
that the law on tho subject bo so framed as
to guard against immediate desertions after
marriage
Resolved that in cases of felony less than
capital tho same number of peremptory
challenges be allowed the state as allowed
the defense
Resolved that the code of criminal pro-
cedure bo so revised that a peace oftlccrmay
eccute warrants in any county in the
stato
Resolved that when defendant refuses
to testify in his own behalf the stato be
allow cd to comment on such failure to tho
detriment of the defendant
Resolved that each and every countj and
district attorney present be ureed to use
his influence in securing votes for the con-
stitutional amendments relating to tho u
diciary which is to bo submitted to the
people on Aueust 11
Resolved that anj person who shall shoot
into a private house or residence with will-
ful intent shall be punished with imprison-
ment in the peniteutiary for a torm not less
than three years nor exceeding five
Resolved that no playing at cards bo al-
lowed except in privito residences and that
such place be so defined as to leave no
noubt as to what constitutes a private resi-
dence
Resolved that tho law bo so revised as to
give justice courts jurisdiction in cases of
carrying concealed weapons and disturbing
public worship
Resolved that where a sheriff is encaged
in conducting criminals from one point to
another that he be allowed mlleago for the
prisoner and bo allowed to charge the samo
un to defendant
Resolved that the two words drug stores
bo stricken from article ISO of the penal
code
Resolved that in cases where it is not
possible to produce the body or a

conviction and where conviction might be
had except for this law it be not necessary
to produce the body or any part thereof
The above suggestions for revisions were
submitted to the committee on resolu-
tions which will report back to the
convention its opinion as to the advisability
of asking the legislature to comply with the
requirements embodied in the resolutions
Several other resolutions ot minor im-
portance were submitted to the committee
the report of which will be submitted to

While waiting for the committee on reso-
lutions to report remarks as to the de-
ficiencies of the present penal laws and the
methods of enforcing them and sugges-
tions as to the best manner of improve-
ment were made by several attorneys
After a motion was carried to instruct
the committee on resolutions to report to-
day at 930 a m the convention adjourned
to meet today at 9 oclock

Matters were rather quiet around the jail
yestorday J A Dickson the darkey
charged with assaulting a small boy when
the circus was here a few days ago was
arrested by Deputy Joyce yesterday and
placed behind the bars

is in custody He was overhauled at Dodge
City Kan last night on a telegram from
Sheriff Tiernan and tomorrow morning an
officer will go after him and bring him
back Uphams offence is selling liquor
without license Last Tuesday in the
criminal district court he wis fined 450 and
costs Ho moved for a new trial and it
was granted upon his giving bond of 1000
for his appearance next day That night
Upham packed his baggage and skipped
out in the early morning ostensiblj for San
Francisco where he said he had been
matched to fight Patrick Gorman an Aus-
tralian middleweight for SJ0O0 before one
oftheathlotio clubs of California Unless
he has tho funds to paj his fine and costs

the arrest of one C H Ellis will be inter-
ested to know that the manager of the con-
cern he represented is also behind tho bars
as is attested by the following dispatch to

Osawatomic Kan July 15 Xi S Cook
representing the Phoenix Savings Invest-
ment Trust company of Kansas City Mo
was arrested hero yesterday evening
on the charge of obtaining money
under false proteoses The arrest
was made under complaint of A
C Young one of tho numorous victims of
tin transactions of tho company of which
Cook is manager About sis weeks ago
Cook appeared in this city accompanied By
Messrs Wells and Stevens his agents and
under pretense of loaning money at 6 per-
cent obtained advance fees amounting in
all to several hundred dollars The loans
never came He was induced to come here
for the purpose of buying out the Osawa
tomio building and loan association but
really in order to accomplish his arrest He
was placed under bond to appear at his trial
next Tuesday

Tnc Gazette yesterday morning briefly
chronicled the arrest of W Beneke on a
charge of beating his wife the complaint
being what is termed aggravated assault
in which Benekes statement was given that
the trouble originated over tho christening
of his child
Yestorday evening in response to a re-
quest of Mrs Beneke a Gazette reporter
called at the residence on East Third street
Mrs Beneke state d Thi Gazette was not
correctly informed about the trouble that
nothing was said about the christening or
religion but that Mr Beneke cams homo
drunk on two nights in succession and she
was compelled to undress him and put him
to bed Her oldest son is recovering from
a siege of typhus fever and when he negan
abusing her she says the boy began to
cry and she wa3 afraid the scene would
make him worse and endeavored to quiet
her husband but he became violent
and called her opprobrious names Mrs
Beneke protested when she says he raised
up in bed and threw his shoo at her it
striking her in the side of the bead and in-
flicting a serious wound necessitating the
attention of a doctor She desired that a
correction be made and that the impres-
sion the trouble arose over religion be dis-
pelled

Those in the vicinity of the public square
yestorday were startled by the report of a
pistol from the Spring Palaca saloon on
the west side of tho square Several ran
towards the place from whence the report
Mime and were immediately followed by a
large crowd everyone thinking a murder
had occurred When 00 had probably col-
lected in and around tho saloon excitedly
demanding who had been shot it was
learned that the causo of the excitement
was the premature discharge of a pistol
Max Richards was explaining to a friend
tho workings of a new pattern of a revol-
ver having the gun against his body In
some way it was discharged sending the
bullet through the ceiling and kicking
Richards in the stomach so hard as to com-
pletely knock him off his feet
