Is a will all that I need?
No. If you want to name specific individuals as beneficiaries of insur-
ance policies (or other such accounts), you should make these designa-
tions through the companies holding such policies or accounts. In order
to have a person act on your behalf or handle your affairs if the need
arises you must execute a General Durable Power of Attorney that names
a person you trust as your Attorney-in-Fact.
You may also execute a Special Durable Power of Attorney which will
allow your Attorney-in-Fact to handle only certain specified transac-
tions. It is also a good idea to appoint a guardian in case a guardianship
becomes necessary. This can be done with a Designation of Guardian,
which allows you to designate the person you want to act as your guard-
ian. More importantly, the Designation of Guardian allows you to name
specific persons you do want to serve as guardian.
Are life insurance benefits distributed in my will?
Not unless you designate your estate as your beneficiary on your life
insurance contract. If you name an individual or entity as the benefi-
ciary of your life insurance it will be distributed to that person or entity
outside your will and not subject to your debts.
What if I become incompetent and am unable to make decisions?
Your Attorney-in-Fact will be able to act, as long as you have executed
Durable Power of Attorney. Otherwise, a guardian must be appointed for
you by the court. If you are concerned about what will happen to you if
you are unable to care for yourself and you are being kept alive through
artificial means, you may want to execute a Directive to Physicians, also
called a Living Will. This document will give your doctor, under certain
guidelines, the right to terminate the use of life support systems.
What about health care decision-making?
A Health Care Power of Attorney will give the person you designate the
ability to make health care decisions once you become unable to do so.
