or may not be exempt and you should check with a lawyer. Distribution
from a pension plan, alimony payments and personal injury awards ma
be wholly or partly protected. If you come into a lump sum of money
that is protected from garnishment or attachment and put it into your
bank account, under certain circumstances it will probably lose its pro-
tected status and be subject to seizure by creditors. Check with a lawyer
before assuming that your lump sum is safe.
PUBLIC BENEFITS
Social Security Disability Income (SSDI)
When applying for SSDI, you will also be applying for future Medicare
benefits. There is a 24-month waiting period from the onset of disability
before Medicare benefits become effective.
Supplemental Security Income (SSI)
SSI differs from SSDI in that it is a need-based program, with limitations
on the amount of income and resources you can have in order to be
eligible. Eligibility is based on disability and financial need. The dis-
ability standard is the same as that used for SSDI. When applying for SSI
benefits, you will also be able to apply for Medicaid benefits. Both are
need-based programs and your eligibility will depend on your current
income and resources.
Applications for both SSDI and SSI are accepted at your local Social
Security office. If you are unable to travel to the SSA office, the forms
can be mailed to you.
The Social Security Administration has disability guidelines specific to
people with HIV infection that may allow you to begin receiving ben-
efits pending a final determination of disability. You should consult
