A LEGAL GUIDE FOR TEXANs AFFECTED BY HIV
and any place that provides social services. The ADA prohibits these
businesses from discriminating against you by denying you service or
providing you different or segregated services from those provided to
other people. The ADA permits this type of discrimination only when a
person with HIV infection would pose a direct threat to the health or
safety of others. This is unlikely to be true for the types of services
provided in almost all public accommodations, including health care
providers.
What if some state or local government agency discriminates against
me based on my HlV status?
The ADA also prohibits disability-based discrimination in the provision
of public services. "Public services" are the programs or activities pro-
vided by public entities such as state or local governments. Contact an
attorney to find out if you have a legal claim.
ADOPTION AND PARENTAL RIGHTS
What is the law concerning adoption and the parental rights of gays
and lesbians in Texas?
Currently, Texas courts are guided by the principal that a child may
remain or be placed with an individual or couple if it is in the best
interest of the child. There is no restriction to the placement of a child
with an individual or couple based on the sexual orientation of the
individual or couple. Texas courts generally encourage the placement
of children with relatives of a deceased or incapacitated birth parent
whenever possible.PAGE 23
