these reports shall be available to the public as provided by
Subsection (e) of this article for other reports.
(h) If the board determines that certain information or
reports submitted under this article would reveal or might reveal
the identity of any individual or associate specific individuals
with a specific company, the board shall declare that information
or those reports confidential and that information or those reports
may not be made available to the public. Information made
confidential under this article may be examined only by the members
of the board, the commissioner of insurance, and employees of the
board.
(i) Data and information reported by an insurer are not
subject to public disclosure to the extent that the information is
protected under the open records law, Chapter 424, Acts of the 63rd
Legislature, Regular Session, 1973 (Article 6252-17a, Vernon's
Texas Civil Statutes). The data and information may be compiled
into composite form and made public if information that could be
used to identify the reporting insurer is removed.
SECTION 5. Chapter 22, Human Resources Code, is amended by
adding Section 22.023 to read as follows:
Sec. 22.023. PAYMENT FOR CERTAIN INSURANCE COVERAGE. (a)
In this section, "AIDS" and "EIy" have the meanings assigned by
Section 9.01, Ccmrunicable Disease Prevention and Control Act
(Article 4419b-i, Verncn's :exas Civil Statutes).
b) Subject to the limitations in Subsection (c) of this
section, the department may purchase and pay the premiums for a
conversion policy or other health insurance coverage for a person
