Dear Professor Tribe,
I wanted to write to review with you the issue of the press conference
on January 21, 1986. First of all, as we discussed earlier, our intention is
to announce to the press our filing the petition of review. The reasons for doing
so are as follows: (1) timeliness - Our papers will be filed on the 20th,
(2) posturing - To reaffirm our commitment to "finish what we started", our
determination to continue our struggle for justice, (3) education- To establish
a dialog about the issue of homosexuality; to develop a better understanding of
the gay issue and how laws like 21.06 hurt the homosexual and are inconsistent
with the spirit of the U.S. Constitution, (4) fund raising - To keep the issue
before the gay community. This awareness will, hopefully, encourage their
financial support of the case.
It would be very helpful if you, Brian, or Kathleen could jot down some
notes on issues you think we would want, or not want, to discuss. Also, as
we discussed on December 13, it would be very helpful if you could forward
a statement on the AIDS issue that we can study and use if and when that question
is raised from the media.
I know you stated yourdesire not to participate in the press conference on
the 21st. Somehow, owever, I feel a little insecure going into this type of
media event without~'4egal counsel with me. Is it possible for you to either,
(1) reconsider your position, (2) let Kathleen or Jim Barber be there, (3) have
the legal issues thoroughly discussed with Tom Coleman who will be there? I might
be unnecessarily nervous about this point, but I wanted to raise it with you
one more time.
Well, that's about all for now. I hope this has been a happy holiday season
for you and yours. I look forward to talking with you again.
