WHEREAS, Section 2.025 of the Texas Election Code requires a spe-
cial runoff election to be held not earlier than the twentieth day or later
than the thirtieth day after the date of the final canvass;
NOW, THEREFORE, I, RICK PERRY, Governor of Texas, under the
authority vested in me by the Constitution and Statutes of the State of
Texas, do hereby order a special runoff election to be held for State
Senate on Tuesday, the 17th day of February, 2004, for the purpose of
electing a State Senator for District No. 1.
Early voting by personal appearance shall begin on February 9, 2004
pursuant to Section 85.001(b) of the Texas Election Code.
The Secretary of State will take notice of this proclamation and will
mail a copy of this order to the County Judges in Bowie, Camp, Cass,
Franklin, Gregg, Harrison, Lamar, Marion, Morris, Panola, Red River,
Rusk, part of Smith, Titus, Upshur, and Wood counties and all appro-
priate writs will be issued and all proper proceedings will be followed
to the end that said election may be held to fill the vacancy in District
No. 1 and its result proclaimed in accordance with law.
IN TESTIMONY WHEREOF, I have hereto signed my name and have
officially caused the Seal of State to be affixed at my Office in the City
of Austin, Texas, this the 28th day of January, 2004.

WHEREAS, a vacancy for election purposes now exists in the mem-
bership of the State Senate from Senate District No. 31, which con-
sists of Andrews, Bailey, Cochran, Crane, Dallam, Deaf Smith, Ector,
Gaines, Glasscock, Hansford, Hartley, Hemphill, Howard, Hutchinson,Lipscomb, Martin, Midland, Moore, Ochiltree, Oldham, Parmer, Pot-
ter, Randall, Roberts, Sherman, and Yoakum Counties; and
WHEREAS, the final canvass of the results of a special held on January
20, 2004, to fill such vacancy was completed on January 28, 2004, and
no candidate in the special election received a majority of the votes cast
as required by Section 203.003 of the Texas Election Code; and
WHEREAS, Section 2.025 of the Texas Election Code requires a spe-
cial runoff election to be held not earlier than the twentieth day or later
