plaintiff that they owned in fee sim-
ple the land hereinafter described
and on said day made, exeeuted
and delivered to plaintiff their deed
of conveyance to 320 acres of land
in Palo Pinto county. Texas, known
as Texas & Emigration & Land
Company survey no. 177(1, patent
NO. 109, vol. 21, abstract no, ool;
said patent recorded in Iniok “p”

county. That plaintiff relied upon
arid believed true the representa-
tions as to title to said land so made
by said G. W. Norton an*l W. F.
Norton and accepted said convey-
ance from them and paid them
therefor in cash the sum of #(>75,
That by said deed of conveyance
they, the said Nortons, bound them-
selves, their heirs, executors arid

said land against the claim of every
person whomsoever claiming the
same or any part thereof adversely
to plaintiff.
That said Geo. W. Norton is non-

and as such are the owners of prop-

their said ancestor, situated in Palo

on said warranty made by their
said ancestor as aforesaid to this
plaintiff. That plaintiff relying
upon said warranty of and repre
sentation as to title of said land,
went into possession of same and
remained in undisturbed possession
thereof until about July 1st, 1901,
when he discovered for the first time
that said Geo. W. and W.F. Norton
had never in fact owned or had anv
title to said land, but that a valid,
superior and outstanding title in
fee simple thereto, existed at the
time of plaintiffs receiving said con-
veyance and had ever since re-
mained in one Mrs. Fannie T. Moore,
the wife of one Leon L. Moore, who
was a married woman on said Jan-
uary 24, 1883, and so remains to
this date. That onsaidto-wit: July
1st, 1901, said Fanny T. Moore wns

land and was so claiming to be

plaintiff from said lands which they
could and would have pro
do. That said eviction bei
nent and plaintiff fearing same,
order to protect his possession of
said land, was loreed to and did ,on
