Police arrest man,
woman for fighting
A man and a woman were arrested Tuesday afternoon for fighting

the time of the report. Bonds of $325 were set for both.
Woman reports auto burglary
A woman told police Tuesday that her vehicle had been burglar-
ized between Monday night and Tuesday morning in the 400 block
of East Humble Avenue. She reported about $560 worth of stereo
equipment stolen.
Man reports wife, child missing
A man told police Tuesday that his wife left home with their 2-
year-old child last Thursday evening. The man spoke with his wife
the next day and she said she would return home with the child, but
had not as of late Tuesday. The man was concerned because the wife
left without extra clothing for the child. Both the woman and child
have been listed as missing persons.
Resident reports buiglaiy
A woman told police that a juvenile she had permitted to live at
her home in the 200 block of Arbor Street had broken in some time
between Friday and Sunday and stolen $150 worth of jewelry and
precious metals from the home.
Woman arrested for local warrants
Police arrested a woman Tuesday in the 3200 block of North
Main Street for eight outstanding local and other state warrants.
Bonds set totaled more than $2,000.
Reported theft leads to arrest
Police arrested a woman Tuesday at a department store on Garth
Road. More than $200 worth of property was reported stolen. The
woman’s bond was set at $5,000.
Traffic stop results in arrest for warrants
A man was arrested early Wednesday in the 300 block of West.
Texas Avenue for 13 outstanding local warrants after being stopped
for a traffic offense. Bonds set totaled more than $2,000.

During a 24-hour period between Tuesday and Wednesday, the
Baytown Police Department responded to eight alarms, one reported
assault, one reported burglary, five reported disturbances and seven
reported thefts. Police also responded to one major accident and 12
minor accidents.

Developers plan to fight until variances granted

north of Interstate 10, a develop-
ment that would be a part of a
much larger site-built Spring-
field subdivision he intends to
build north of the mobile home
park.
Fogarty’s project would have
asphalt streets, tio curbs and a
drainage scheme, elements
allowable under earlier subdivi-
sion requirements, but which are
not allowed under the subdivi-
sion ordinance passed in mid-
1998.
Fogarty said state law allows
the plat approvals obtained when
Fogarty bought the land to trans-
fer to him. Arete Real Estate
Development intends to build the
subdivision with lots no smaller
than the minimum 5,400 square
feet required by the city’s latest
subdivision ordinance.
Angel, in January 1998, filed a
preliminary pl^t for San Jacinto
Park, but through a combination
of events with the Springfield
Municipal Utility District, Harris
County Flood Control District
and time spent waiting for coun-
ty approvals, the final plat was
not filed within the 180 days the
subdivision ordinance in effect at
the time required.
Angel was granted an addi-
tional 90 days, but at the end of
that time a final plat for the park
still was not ready since the park
had not been built. Construction
of such projects must be substan-
tially complete before a final
plat can be approved under Bay-
town’s subdivision ordinance.
If Angel builds his park under
the current subdivision ordi-
nance instead of the ordinance in
effect at the time he filed his
preliminary plat, he would have
to agree to have larger lots, con-
crete streets with curbing and
drainage and other requirements
he said will price the project out
of profitability.
Like Fogarty, Angel believes
approvals and reviews by the city
before the more strict subdivision
ordinance went into effect in late
1998 apply to his development.
Angel, through attorney Knox
Askins, said that “through a lack
of communication by the plan-
ning department, the developer
(Angel) (had) reason to believe
that he had approval of the
extension previously requested.”
. Both Fogarty and Angel have
retained legal counsel with
respect to their projects’ delays,
and Angel said he would consid-
er filing a suit against the city if
he fails to get his variance from
the city touncil.
Angel contends the limit on
filing a final plat — 280 days —
"should begin when any other
entities have completed their
work, not before.”
An ordinance change by tlje
city council would be necessary,
to reposition the extension lim-
its, Ramirez said.

The Lee College building com-
mittee plans to present a $20 mil-
lion campus improvement plan to
the college’s board of regents at
their meeting tonight.
The meeting will be held in John
B. Tucker Lecture Hall at 7 p.m.
The $20 million plan will be the
basis of an expected bond election
next year.
In other business, the board
also considered purchasing two
properties and selling a tax-fore-
closed property.
The board will also consider
purchasing a math lab software
upgrade, student software and
electrical supplies.
