Strange things happon in a court of law concerning the
laws of the land,
Yesterday, in the hearing concerning the matter of the <
most recent Gladewater annexation, the law that was pass-
ed with intention of cutting down time in law suits became
the topic o| discussion that delayed the progress of the hear-
ing.
I.aw 1B9 was originally allowed to “weed out" motions
presented in .1 law suit so when the case came before the
jury it could move at a faster pace thus saving time on the
part of all concerned.
For nearly two hours the pros and cons of this law.
what it did and did not allow became the main subject of
discussion It, not being directly relative to the case <»l the
Magnolia Petroleum company et al vs. the City of Glade-
water, caused Judge Fred Krisman to have the jury remov- ,
od while the discussion was made.
The law to shorten proceeding in a law suit so delayed ,
proceedings yesterday afternoon that very little apparently i
was accomplished.
Despite all the legal terms used, there are just two fac-
tors that the judge of the 124th district court in Longview
has instructed the jury, and those concerned in the law suit!
to clarify <1) Whether or not the parcel of land annexed by
the City of Gladewater as a result of the election held on -
Dec 2ti. I!».r)l. is one parcel of land. <21 Whether or not the
City o| Gi.,dewater acted in good faith in ordering the elec-
tion and the resulting annexation move
In the ail-day-long session yesterday, Albert K Stein-
heimei. surveyor for the Paul G Bentley company, was call-
ed to testify concerning the land area annexed He pointed
out under <|uestioning by attorneys that ho was instructed
by his com pa in in making the survey for the then propos'd
rit\ expansion to make a continuous survey, not more th.-’m
one-hall mile from the established limits of Gladewater. and
not to include the Mumble Camp area for this area had water
and sewage and expansion by the city into this area could
offer little improvement that was not alread\ available to
the camp residents.
A long discussion was made of the line established by
his survey including the •Humble road line" at the north-
east corner that included about two to three acres of land
in a strip extending some 2.200 feet in length.
Steinheimer was asked in fact When an area such as
this under discussion is continuous and in no place touched
the former line of the city limits, is it one or two territories?
