Q: Two years ago, my
friend and her husband sign-
ed a legal separation agree-
ment dividing their com-
munity property. Now, he
wants a divorce and half of
their community property,
since he had spent th^ialf
he received under the separ-
ation agreement. She had
filed for divorce in Texas at
. his request; he lives in Colo-
rado. Would he be entitled
now to half of her property?
A: The trial judge who
hears a divorce case has full
discretion in deciding how to
divide the couple’s property,
including the option to con-
sider a “legal separation’’
agreement executed by the
couple. The judge would not
be bound by any such separ-
ation agreement and there-
fore would be free to award
any or all of the couple’s
community property to ei-
ther spouse. M
Q: How dffttSpiie Social
Security Administration
compute retirement bene-
fits? I’m told that my check
will be based on my total
earnings since 1950 divided
by 25 years. I know several
people who are drawing
Social Security based on the
best five years of income.
A: There is a common mis-
conception that the Social
Security benefits are based
on a person’s best five years
of income. Most benefits are .
based on wages earned since
1951. The benefits are com-
puted by first dropping the
lowest five years of taxable
earnings and then averaging
the remaining years of tax-
able earnings.
Q: I’ve been living with
my boyfriend for almost five
years and I’m referred to as
his wife. We’re living in his
home, which is in the name
of his brother and mother.
Even the checking and sav-
ings accounts are in his
brother’s and mother’s
name. What rights do I
have?
A: In Texas, a man and
woman living together and
holding themselves out as
man and wife are considered
to have a common-law mar-
riage. The wife in a common-
law marriage has the same
legal rights as a wife in a tra-
ditional marriage. Asserting
those rights in a legal pro-
ceeding, such as a divorce, is
a matter of proving owner-
ship through bank deposit
slips and other evidence.
Q: Do doctors have a right
to give or order tests, treat-
ments, x-rays or medication
without the knowledge and
against the will of the pa-
tient? If so, would they have
the right to perform surgery
without a patient’s permis-
sion?
A: A physician must have
either the expressed or
impled consent to adminis-
ter treatment or perform an
operation. This rule is sub-
ject to exception in an emer-

The general rule prohibiting
the performance of an opera-
tion without the consent of
the patient extends to the
performance of operations
different in nature from' that
for which a consent was
given, and to operations in-
volving risks and results not
contemplated.
Q: I received the final bil-
ling for some merchandise
we recently purchased and
paid with a check marked
PAID IN FULL. The store
cashed my check but the
following month sent anoth-
er bill for payment. Am I
legally expected to pay this
second bill?
A: Assuming you paid the
account in full, you are not
obligated to pay the second
bill. However, unless there
is a bona fide dispute be-
tween the debtor and credi-
tor as to the amount owed,
the mere payment of a check
for less than the total owed
will not discharge the debt,
even if the check is marked
PAID IN FULL.
Q: My husband and I were
divorced four years ago in
another county. Now, my
husband is considering a re-
quest for additional visita-
tion rights, and it would
place a hardship on me to
travel across the state for
the court hearings. Could I
get the case moved to my
home county?
A: Any attempt to modify
the original divorce decree
must first be filed in the
county in which the divorce
was granted. That court
then could be requested to
transfer the case to your
county of residence.
Q: About 10 years ago, my
neighbor fenced his back
yard and mistakenly extend-
ed the fence on my property.
We made a gentlemen’s
agreement that he would
move the fence if I ever
asked him to. Unfortunate-
ly, he died several years ago
and his heirs refuse to move
the fence at my request.
They claim they now own
the portion of my property
on the other side of the
fence. Is this a valid claim?
A: Under Texas law, it is
possible to acquire title to
real property by possessing
it for certain periods of time
in a manner which is openly
adverse to the ownership of
the person who holds the re-
corded title to the land. The
fence in your situation might
be such a situation. Your
lawyer will be able to advise
you of your rights in this
matter and suggest what
legal action is available to
you.
Q: My brother’s wife
recently divorced him and
now he’s got to pay child
support. My brother says
she was pregnant before
they were married and that
he is not the father. Is there
some way he can prove the
baby isn’t his child?
A: The law in Texas is ex-
tremely strict in presuming
that a woman’s husband is
the father of any child born
or conceived during their
marriage. Unless the hus-
band can prove that there
was no opportunity for him
to be with the mother during
the period of conception, he
will be conclusively presum-
ed to be the father as a
matter of law.
