IN THE DISTRICT COURT, 28TH JUDICIAL DISTRICT, NUECES COUNTY, TEXAS.
PUBLISHED NOTICE OF CLASS ACTION
This notice may effect your rights. Please read carefully.
To: All persons, including minors, who owned property and/or were present in the vicinity of Robstown,
Texas, on October 23 or 24, 1992, and who may have suffered personal injury or property damage from
exposure to the chemical release which occurred on those dates from the Occidental Chemical
Corporation butadiene plant located east-northeast from Robstown, Texas.
Your rights may be affected by the lawsuit pending in this Court, Civil Action No. 93-1987-A.
Plaintiffs in this lawsuit allege that Occidental Chemical Corporation and the other Defendants listed above were negli-
gent, grossly negligent, and acted with malice in connection with a chemical release from the Occidental Chemical
Corporation butadiene plant east-northeast from Robstown, Texas on October 23 and 24, 1992.
Plaintiffs allege that they were exposed to this chemical release in the vicinity of Robstown, Texas, and that they suffered
personal injuries as a result of this release. Plaintiffs seek to recover damages for their alleged personal injuries, as well as
punitive damages. OxyChem and the other defendants deny the allegation of wrongdoing and have asserted various defenses.
The Court has not ruled on the merits of the Plaintiffs’ charges or on the denial or other defenses made by Occidental Chemical
Corporation. The Court has, however, ruled that this lawsuit may be maintained as a claim for damages, punitive damages,
and costs not only by the Plaintiffs, but also on behalf of a mandatory class consisting of certain persons as follows:
All persons including minors, who owned property and/or were present in the vicinity of Robstown, Texas on
October 23 or 24, 1992 and who may have suffered personal injury or property damage from exposure to the chem-
ical release which occurred on those dates from the Occidental Chemical Corporation butadiene plant located
east-northeast from Robstown, Texas.
The Court has not yet determined the precise geographic area in the vicinity of Robstown that was potentially exposed to
the release. However, after further hearing, the Court or a jury will issue a special finding identifying the potentially exposed
geographic area.
Plaintiffs, Don Grant, Hilda Bayardo, Mary Lou Schanen, Leo Schanen, Amie Schanen, Stephanie Schanen, Tammy
Schanen, Emma Cabrera, Dario Cabrera, Andres Cabrera, Darian Cabrera, Felipe and Juanita Flores, Jaimie Flores, Francisca
Garcia, and Belinda Ramon will serve as class representatives for the class. The Court has designated the law firms of Allison
& Huerta and Edwards, Terry, Baiamonte & Edwards, of Corpus Christi, Texas, as lead counsel for the class. However, class
representatives and/or class counsel are subject to change at a later date.
Establishment by the Court of this class means that the ultimate outcome of this lawsuit, whether favorable to the Plaintiffs
or to the Defendants, will apply in like manner to the class members; that is, to all persons who allege to have suffered per-
sonal injury or property damage as a result of the release of October 23 and 24, 1992. You are hereby advised that you, and
any member of this class, have the right to appear before the Court and challenge the Court’s determination as to the class and
its representatives. However, any such challenge to the class and its representatives must be submitted to this Court in writ-
ing no later than December 31, 1994.
You will be required as a condition to participating in any recovery to demonstrate that you suffered personal injury or
property damage as a result of exposure to the chemical release from the OxyChem plant. Individual determinations of injury
will be made in a separate phase of the trial if defendants are found to be legally liable for damages arising from the release.
Persons that have been identified as possible members of this class are being advised by mail of their rights with respect
to this lawsuit (including their right to challenge the Court’s determination as to the class and its representatives). This notice
is being published because some class members may not receive the mailed notice. If you are (or may be) a member of the
class but do not receive individual notice of your rights by November 30, 1994, you are requested to notify Class Counsel,
Allison & Huerta, 920 Leopard, Post Office Box 23080, Corpus Christi, Texas 78403, giving your correct name and address.
You will then be mailed a more detailed explanation of your rights in this litigation and be placed on the mailing list for any
future notifications regarding this suit.
