at the top at an escalator on
Nov. 24. 1964. The escalator had
been installed that same day by
| Otis.
The woman, then 61, ran to
I rescue the child and in doing so
was jerked violently forward by
the moving handrail through ”’a
hole” or open space adjacent to
| the rail, court records show.
She was left hanging over a
[30-foot drop. This aggravated
her high blood pressure and dia-
betes and leaned her heart by
cutting off oxygen, she said. She
cued Otis for negligence in the
design of the escalator because
| of the "hole.'’
The court of civil appeals af-
| firmed the judgment. The Su-
preme Court Mid it would hear ,
arguments on seven of the SC
points of error the defendant
ascribed to the trial court.
Texas Court Will
Hear Case Against
[Alice Physicians
AUSTIN (AP) -The Texas
Supreme Court agreed today to
review a malpractice suit
brought by- a woman who
claimed she was so doped up on
medicine she was incapable of
approving an operation per-
formed on her at the Physicians
and Surgeons Hpspital in Alice.
The high court set a hearing •
in the case for Feb. 21.
Mr. and Mrs. C. K. Graves Jt.
filed the suit tfter an Oct. 24.
1963, exploratory operation by
Dr. Philip S. Joseph. Mrs.
Grave*, who had been admitted
to the hospital two days before
complaining of abdominal pains,
contends that since the opera-
tion she has had bladder trouble
and has been partially para-
lyzed.
Testimony at the trial showed
X-rays indicated small intestinal
loops were dilated, and her blood
count was up, and also her
husband told Joseph: "We’ve
got to do something, Doc, or I
am going to lose Elma."
The trial court ruled against
Mrs. Graves, finding there was
an emergency and '"in such a
situation, there is respectable
authority that the practitioner
may be justified in performing
an operation without the express
consent of the patient or anyone
authorized to act in hi« behalf.’'
The San Antonio Court of Civil
Appeals upheld the trial court
ruling.
The Supreme Court agreed to
hear the case on three alleged
points of error: That no emer-
gency existed, that Mrs. Graves
did not know what she was doing
•50 per cent of the time because
,.f pain killing drugs and was
not capable of consenting to the
operation, and that her hus-
band’s consent to the operation
did not give doctors permission
to go ahead.

Student Pleasure Fund

In the last 12 yean, Wofford
College has provided student
mans for such things as stereo
and hi-fi sets, a trip to a moun-
tain resort, a second-hand car
and karate lessons.
All of the loans were granted
[by the college administration
to rough a "pleasure fund.” es-
tablished 13 years ago by an
anonymous Wofford graduate
who said he didn't want any stu-
dents to go through Wofford
"without having any fun.”
More than 1,500 student* have .
borrowed up to 150 each through
■lie "pleasure fund." Students

which goes back into the fund
