termine to take over said schools.
(1). The Board of Aldermen shall
have the power and it shall be their
duty to determine the amount neces-
sary and requisite to be levied, as-
sessed and collected each year and
from the money derived therefrom,
apportion a sufficient amount thereof
to each of the respective funds herein
above mentioned, necessary to pay the
expenses thereof, the interest and
create the necessary sinking fund,
from time to time, as conditions may
require and as may to determined hy
the Board of Aldermen in order to

All such bonds shall specify for
what purpose they are issued, and
provision shall be made at the time
of issuance to pay intereat and create
a sinking fund sufficient to pay the
principal at maturity.
Neither the money for which such
bonds may be sold nor the money
raised to pay the interest and sinking
fund theerof shall be diverted to any
other purpose and the City Treasurer
shall not honor any draft drawn on
said interest and sinking fund except
to pay the interest on said bonds or
to redeem the same except as herein-
after provided.
Whenever the accumulated sinking
fund upon any bond issue shall amount
to as much as one thousand dollars,
the same shall be applied at once to
the discharge of a like amount of aaid
bonds, and should the Cttv not be
entitled to redeem aiyr such series,
and the holder be unwilling to surren-
der the same, said fund shall be in-
vested in other valid interest paying
bonds of the City of Graham or of
the United States, or of the State of
Texas, or any legally issued bonds of
any county, city or school district, as
the Board of Aldermen may determine.

Plaintiffs further allege that said
judgment has been fully paid off and
discharged by the conveyance of cer-
tain personal property consisting of a
standard derrick and rig irons com-
plete, together with approximately two
miles of 2-inch water and gas line, all
necessary fittings, also one 1600 barrel
wood tank, and about 8800 feet of 5
3-16 inch oil well casing. That said
property was duly transferred to the
defendants herein and accepted by said
defendant* in full and complete satis-
faction of said judgment and debt.
That said judgment or any lien created
or asserted thereby should be cancelled
and annulled. ,
Wherefore, plaintiffs pray that de-
fendants he cited to appear and answer
