Death Claims
Former Resident
Earl Cecil McManus, Sr.,
a former Mercedes resi-
dent, was fatally stricken
while driving a car last Fri-
day in Brownsville.
He was born in Verda,
Louisiana, May 30, 1900.
He had lived in Mercedes
from 1914 to 1931. Later
living in McAllen, Harling-
en, and for the past 17 years,
in Brownsville.
He was a member of the
First Baptist Church in
Brownsville, and was en-
gaged in the furniture bus-
iness. Funeral services
were held in the Stotler Mor-
tuary Chapel, Sunday, 3 p.m.
with Rev. Billy Lucas, pas-
tor of the First Baptist
Church of Brownsville, of-
ficiating. Burial was in Eb-
ony Grove Cemetery. Sur-
vivors include his widow,
Mrs. Ellen McManus,
Brownsville; son, E. C. Mc-
Manus, Jr., Brownsville;
brother, George McManus,
Corpus Christi; seven sis-
ters, Mrs. George Rippert
of Weslaco, Mrs. D. T.
Campbell of Mercedes, Mrs.
Ernest Bennett of Browns-
ville, Mrs. James Johnson of
Dallas, Mrs. Phil Barstow of
Morgan City, La., Mrs. Don
Ridenour of Corpus Christi,
and Mrs. Leander Leake of
La Feria.
A former Mercedes
science teacher who recently
was named dean of Texas
A & I College became ill
last week and was rushed
to Sophn Hospital in Cor-
pus Christi.
Relatives reported Dr.
James Robinson in critical
condition after suffering the
attack involving blood ves-
sels in the brain area.

Judge Approves
t Beer Tavern
Permit Here
County Judge Milton Rich-
ardson issued a permit for
beer sales to the. Cactus
Lounge on West Hwy. 83 in
Mercedes despite a protest
by the Mercedes city com-
mission.
However, Mayor A. J. Ha-
gan said the judge signed
the permit since no legal
ground could be found for
refusal as far as the beer
permit was concerned. The
only issue involved was
whether the area was wet or
dry. The judge and applicants
contended the area was wet
and that annexation by the
city did not change its status.
Meanwhile, the permit
does not become valid until
finally approved by the Texas
Liquor Control Board in
Austin. Pt was understood
that the district agent is
holding up the permit 10
days to allow the city time
for an appeal if it so de-
sires.
It was pointed out that even
if the city loses its appeal
to the liquor board, it has
recourse to the civil courts
through its zoning ordinance.
Gene P. Hobart, who also
has property in the vicinity
of the tavern, said he planned
to seek a temporary injunc-
tion and to appeal if neces-
sary.
Earlier it had been believ-
ed that a newly-annexed area
automatically became dry
until a vote was taken after
the annexation. The city at-
torney was not present and
this point was never cleared
up.
Unless proof can be pro-
duced within 10 days that the
area is dry, the lounge un-
doubtedly will be given its
permit by the board and al-
lowed to operate, at least
until civil action can be
started.
The matter came to pub-
lic light recently when the
commission approved grant-
ing of the permit. How-
ever, at subsequent meet-
ing when new evidence was
produced, the commission
revoked its permission for
the permit on the grounds
the newly-annexed area i's
presently zoned for residen-
tial and not commercial.

guided a bankrupt state through that bitter Civil War year.
