brief statement of the cause of ac-
tion being as follows;
That the City of Crystal City, bv
ordinance dated July 8, 1930, levied
a special assessment against J. B
Shaw as owner of and against Lot 13
in Block 35, fronting 25 feet on the
East side of East Zavala Street, in
the City of Crystal City, Zavala
County, Texas, for the special bene-
fits from improvements constructed
in front of said lot. That a certificate
?L^pecial assessment dated Julv 8
1930, was issued by said City to
fiaintiff, and same recites the facts
aforesaid, and evidences that there-
by arose a debt against the said J.
B. Shaw as a personal liability in the
sum of $104.25, with interest, and on
default reasonable attorney’s fees

Section 5. Cities having more
than five thousand (5000) inhab-
ltants may, by a majority vote of the
qualified voters of said city, at an
election held for that purpose, adopt
or amend their charters, subject to
such limitations as may be pre-
scribed by the Legislature, and pro-
vicung that no charter or any ordi-
nance passed under said charter
shall contain any provision incon-
sistent with the Constitution of the
State, or of the general laws enacted
by the Legislature of this State; said
