To the Sheriff or any Constable of
Edwards County, Texas, Greeting:
You are hereby commanded to sum-
mon J. E. Price, and the heirs of J.
E. Price, and the heirs of the heirs
of the said J. E. Price, the names and
places of residence of such heirs, and
heirs ,of such heirs, being unknown,—
to be and appear at the next regular
term of the District Court of Edwards
County, Texas, to be held at the
Court House of said County in the
town of Rocksprings, Texas, on the
11th day of February, A. D. 1929,
the same being the second Monday in
February, then and there to answer a
petition filed in said Court on the 10th
day of January, A. D. 1929, in cause
No. 1430, wherein C. W. Laughlin is
plaintiff, and J. E. Price, and the heirs
of J. E. Price, and the heirs of the
heirs of the said J. E. Price, are de-
fendants, the nature of the plaintiff’s
cause of action and demand being al-
leged substantially as follows, to-wit:
1st. That plaintiff is a resident of
Edwards County, Texas, and that
.ht residence of the defendants and
:ach of them, is unknown to plaintiff.
2nd. That on or about the 1st day
of January, A. D. 1929, plaintiff was
lawfully seized and possessed of the
following described land and premises,
situated in ^dwards County, Texas,
lolding the same in fee simple, to-wit:
All of block No. 47 in the City of
Rocksprings, Texas, according to the
map or plat of the town of Rock-
springs, Texas as recorded in Volume
2, at page 603 of the deed records of
Edwards County, Texas.
3rd. That on the day and year last
aforesaid, defendants unlawfully en-
tered upon said premises and ejected
plaintiff therefrom and unlawfully
withhold from plaintiff the possession
thereof to his damage in the sum of
Three Thousand Dollars (83,000.00);
that the reasonable annual rental value
gf said land and premises is Five
Hudred Dollars ($500.00)
4th. Plaintiff avers that he and
those whose estate, he-has and holds,
have had peaceable, continuous and
adverse possession of the lands des-
cribed, cultivating, using and enjoy-
ing the same and paying all taxes due
thereon, claiming same under deed and
deeds duly registered, for a period of
more than five years before the com-
mencement -of this suit.
* Plaintiff avers that he and those
whose estate he claims have had and
held peaceably, the lands above de-
scribed, and adverse possession of the
same, cultivating, using and enjoying
the same for a period of more than
ten years next before the commence-
ment of this suit and claim to have
good and perfect right and title to
said lands and premises.
5th. All of the facts aforesaid plain-
tiff stands ready to verify and by rea-
son whereof he says he has good title
to the lands aforesaid and is entitled
to recover the same and that any claim
or title of the defendants, if any they
have, is inferior to the claim and title
of this plaintiff, and is barred by the
Statutes of Limitation.
Wherefore, plaintiff prays that de-
fendants be cited to appear and an-
swer herein according to law; and
that plaintiff have judgment for title
and possession of the above describ-
ed land and premises, and that Writ
of Restitution issue and for his rents,
damages and costs of suit, and for
such other and further relief, special
and general, in law and equity, as he
may be entitled to.
You are further commanded to
serve this citation by publishing the
same once in each week for four suc-
cessive weeks previous to the return
day hereof, in a newspaper published
is published in said county, then in
the nearest county where a newspaper
is published.
Herein fail not, but have you before
said Court, on the said first day of
the next term thereof, this writ, with
ycur return thereon showing how you
have executed the same.

fully siezed and possessed of the fol-
lowing described lands, and premises,
situated in Edwards County, Texas,
holding and claiming the same in fee
simple, to-wit:
Survey 23, Block V-7, cert 1298,
Original Grantee H. E. & W. T. Ry.
Co., containing 640 acres of land.
That on the day and year last
entered upon said premises and eject-
ed the plaintiff therefrom and unlaw-
fully withheld from him the posses-
sion thereof, to his damage in the
sum of Two Hundred and No.jlOO
($200.00) Dolllars.
That the reasonable annual rental
value of said premises is One Hun-
dred and NojlOO ($100.00) Dollars.
Plaintiff further alleges, that he,
claiming the same, has had and now
has, peaceable, continuous and adverse
possession by an actual enclosure of
the land mentioned in plaintiff’s pet-
ition, using and enjoying the same for
the period of ten years before the
commencement of this suit and this
he is ready to verify.
Wherefore, plaintiff prays judgment
of the court, that the defendants, John j
D. Abbott and the unknown heirs of
John D. Abbott and the unknown
heirs of the unknown heirs of John
D. Abbott and Maria G. Abbott wife
of John D. Abbott and the unknown
heirs of Maria G. Abbott and the
unknown heirs of the unknowm heirs
of Maria G. Abbott and George Huber
and the unknown heirs of George Hu-
ber and the unknown heirs of the un-
known heirs of George Huber, and
Francilla G. Huber wife of George
Huber and the unknown heirs of
the unknown heirs of Fran-
cilla G. Huber' and Sadie M. Hu-
ber and the unknown heirs of Sadie
M. Huber and the unknown heirs of
the unknown heirs of Sadie M. Huber
and John P. Vanausdall and the un-
known heirs of John P. Vanausdall
and the unknowm heirs of the un-
known heirs of John P. Vanausdall,
be cited by publication to appear
and answer this petition and that
upon a hearing plaintiff have judge-
ment for the title and possession of
the above described lands and premi-
ses, and that writ of restitution issue,
and for his rents, damages and costs
of court, and for such other and fur-
ther relief, special and general in law
or in equity that he may be justly en-
titled to and in duty bound will ever
pray.
Herein Fail Not, and have before
said Court, at its aforesaid next re-
gular term, this writ with your re-
turn thereon showing how you have
executed the same.
