tives, devisees and legatees\of each
and all of the above named persons
all deceased, are defendants, said pe-
tition alleging that on or abouit the
first day of September, A. D. \1908,
plaintiff was and now Is seized \and
possessed of the tracts of land he'
matter described stiualed In Mills
county, Texas, holding the same in
fee simple, to wit:
1. The Simpson Pulliam 80 acre
survey patented to him by letters
Patent No. 789, Vol. 4, dated. January
15, 1871, bv virtue of Script No, 716,
Abstract No. 544, and more fully des-
cribed by metes and bounds in the
patent thereto.
2. 67 acres of land more or less,
out of the Milton Yates survey pat
ented to the heirs of Milton Yates by
Patent No. 579, Vol. 20, dated March
19, 1875, Bald 67 acres being meted
and bounded as follows, to wit: Be-
ginning at the H W corner of the
Henry Thurwester survey a stone
mound in the north liae of the Ke-
siah Dunn snryey. Thence N 871 vrs
to 8 E corner of a 255 acre tract out
of said Yayes survey. Thence W 435
vrs to the place of beginning,
3. Ali of me following described
tract or land out oi the Kesiah Dunn
league and Burvey patented to her,
by Patent No. 181, Vol. 7, dated Dec
ember 8, 1847, meted and bonnd as
follows: Beginning at a Btake on
bank of Colorado river the 8 VV cor-
ner of Thos. Blackwell survey No. 57,
for the n w corner of tjhis survey
from which a P, O brs n 3t w 10 yrs.
Thence down tbe river wiin its
meanders s 330 vrs s 18 W 520 s’45: w
300 vrs 8 32 w to the n w curher t
a 50 acre tract puts of s^id eucvev, be-
longing to the fi^irs of'Colin Steward
Thence east1 Wlth the north1 line of
said 50 acre- tract to the cteuter of
Blow-out creek. Thence in a east-
erly direction with the meanders of
said creek, to the n e corner of 160
acre tract out of said survey, belong-
ing to the heirs of Colin Stewart, at a
point 1901 vrs w of Colorado river.

fences of the Colin Stewart traot, and
D. A. Autrey 251 aore tract, now
owned by G. W. Bull, 1000 vra to the
n e corner of the said D. A, Autrey
tract, as established by Geo Resley
surveyor, September, 26, 1890, at a
point 1800 vrs e of the s w corner of
Kealab Dunn survey, a mee quite brs

line of the Kesiah Dunn survey 8540
vrs to its s e corner a stone mound in

session thereof^ to his damage In the
sum of Ojgfe Thousand (1000.00) dol-
lars.
Pik-ntiff further alleges, that he
and those whoBe estate he his, elaim-
to nave good and perfect title to
fha above d,escribed tract of land,
now has and has had peaceably the
land claimed, and open, notorious
and adverse posessiori of the same,
cultivating, .using and ebjoj lug the
same, and by aotual enclosure for a
period of more to an ten years after
tbe defendants cause of action ac-
crued and before the commenoe-
mant of this suit.
Plaintiff further alleges that he and
the those whose estate he has, and
under whora.he claim?, claiming the
same bv deeds duly registered in
Mills county, has had and held peaoe-
able, continous and. adverse posses-
sion of said land and tenements above
described, claiming, cultivating, us-
ing and enjoying the same, and pay-
ing all taxes thereon, for a period of
more than five years after defendants
cause of action accrued and before
the commencement of this salt.
That the said deeds under which
plaintiffs claims, are filed among the
papers In this cause and notioe
thereof given to the defendants and

aot extent and nature of defendants
claim to the above described land
and tenements is unknow to him, exy
oept that he1 is informed that the ap-
parent record title to a portion
thereof is defective and appears to
be in the defendants.
Wherefore premises considered
plaintiff prays that defendants be
cited to answer this petition and
upon trial hereof he have judgment
against eaoh and all of the defendants
jointly and severally for the title and
possession of the above described
premises, etc.
Herein fail not, but have befpre
said court, at its aforesaid next regu-
lar term, this writ with your return
thereon, showing how you have exe-
cuted the same.
