State lawmakers pass school funding bill

With about $4.5 billion in new revenue for 1995-96, state lawmak-
ers allocated an additional $2 billion to public education (a 12 percent
increase), raising spending for both rich and poor school districts, and
fully funding the 1993 school finance law.
For three weeks in May. a 10-member public education conference
committee co-chaired by Senator Bill Ratliff (R-Mt. Pleasant) and
Representative Paul Sadler (D-Henderson) worked out differences
between the two houses The result looks a lot more like the House
version than the Senate version. The transportation allotment and
small district adjustment are left unchanged The only vestige of the
school voucher proposal left in the bill allows public school choice for
parents of students in low-performing campuses. A school district that
establishes a home rule charter, campus charter, or open enrollment
charter would be exempt from numerous state regulations. The final
855-page education bill breezed through the Senate by a vote of 30-1,
and through the House by 116-29, on May 27.
There were some pluses for property-poor districts this session:
• The state fixsd the rollback glitch that was an unintended
consequence of the rollback provisions adopted in 1993.
• Previously, a district that experienced a rapid decline in tax base
exceeding eight percent of the preceding year could appeal to the
Commissioner of Education for a reduction in local fund assignment.
Now, it’s only four percent.
• The state approved a study of facilities weights as part of a
comprehensive study of all weights and allotments.
• The state eliminated the dual election that was required for districts
to issue bonds that would cause the district’s total rate for M&O and
new debt to go above $ 1.50.
• The state changed the amount of additional tax rate that triggers a
rollback election from six to eight cents.
• The state raised the guaranteed yield from $20.55 to $21 to achieve
the goal of maintaining 85 percent of students in districts with substan-
tially equal access to school funding. This will help many poor districts
gain some additional state aid beginning next year.
• In 1996-97, the state will provide $25 million in new funding that
will flow only to Tier 2 districts for alternative schools for violent
offenders. Although the conference committee voted to fund this
program by adding 12 cents to the guaranteed yield level, this mecha-
nism did not get added to the final SB 1. According to the Legislative
Budget Board, the $25 million will probably be distributed as grants to
'Tier 2 districts in 1996-97, subject to the Commissioner's discretion
Other significant changes in the new education bill will affect all
school districts. The state repealed the teacher compensation allotment
and raised the basic allotment from $2,300 to $2,387. with the net
increase designed to cover the new teacher salary schedule.
SB 1 also provides, for the first time. $170 million for the next
biennium in state assistance for a school facilities program to qualifying
school districts. Toqualify.adistrict must have a wealth perunweighted
student (ADA) of less than approximately $274,400, a total effective
tax rate of at least $ 1.30 or an effective debt tax rate of at least 20 cents.
While the conference committee ignored the withholding of the
excess $40 million from Tier 2 districts in the current biennium (and
increased the excess to $60 million for the coming biennium by
funding the extended year program through the set-asides), it had no
problem in providing a $50 million give-away, to the 96 wealthiest
including a "Credit for Appraisal Costs” of $16 million, an “Early
Agreement Credit" of $7 million, and a "Property Value Decline
Protection" worth $21 million. The state is also extending the hold
harmless provision for recapture (Options 2 and 3) for these districts
through 1998, and applying the hold harmless provision for increased
costs imposed by the new teacher salary schedule
To protect wealthy districts whose property values decline, the j
will use current property values, rather than the year-old values no
used, to calculate how much will be recaptured from districts wh
values are declining. The other 943 districts would receive no eqiiiva
lent protection for declining property values.
At one point in the conference committee meetings, co-chair
Paul Sadler announced that the committee had “found” the money t
finance librarians’ pay raises by changing the property value protecti
plan for Chapter 41 districts Later that evening, however. Rep. Sadie
