Group demands area officials resign

resign.
Ruby Benoit, a spokeswoman for
the citizens’ group, said Estrada, Forgey,
Nolan and McCaleb were asked to re-
sign because of their decision to renew
Lake Dallas Police Chief Nick Ristag-
no’s contract to serve as interim city
manager until Aug. 16.
“I reiterated the dual-role issue,” Be-
noit said. “I told them that we are not
their enemy, but we are a force to be re-
spected.”
The citizens’ group is called Lake
Dallas Citizens for Change. It’s one of
several Facebook groups dedicated to
the community. Some of the others in-
clude Lake Dallas Community New-
swire for Truth and Lake Dallas Citi-
zens.
The opinions related to the incom-
patibility of a police chief also serving as
a city manager of a home-rule city if the
police chief reports to the city manager,
she said.
In Lake Dallas, the city manager’s
responsibility includes appointing and
removing the chief of police — subject
to City Council approval — for an indef-
inite term, according to Section 4.02.01
of the Lake Dallas City Charter.
Benoit said City Council members
approved not only Ristagno’s contract,
but also tried to overrule the city charter
when they stated in Ristagno’s employ-
ee contract that it would take three-
fourths of the council’s approval to re-
move Ristagno from office instead of
the simple majority (three of the five
council members) as written in the city
charter.
It is unclear whether a city employ-
ment contract can overrule a city char-
ter in Lake Dallas. City officials did not
return calls or emails seeking comment
as of 6 p.m. Monday.

A representative from a Lake Dallas
citizens’ group appeared before the
Lake Dallas City Council on Thursday
evening, demanding the resignations of
several city officials, including newly
appointed Mayor Mike McCaleb.
Benoit said she provided city leaders
with Texas attorney general opinions
regarding dual-office holding, both
from Jim Mattox, who served as attor-
ney general in the 1980s, and Greg Ab-
bott, who served from December 2002
until last January before taking over as
governor.

AUSTIN — Planned Parenthood sued
again Monday over efforts by Republican
governors to block Medicaid funding to
the nation’s largest abortion provider, this
time against Texas, where the organiza-
tion says health care access to 13,500
women is on the line.
Federal courts so far have halted simi-
lar attempts in Arkansas, Louisiana and
Alabama while lawsuits play out. Texas
plans to kick Planned Parenthood out of
the state’s Medicaid program by Dec. 8.
