First Assistant District Attor-
ney Jamie Beck was one of three
prosecutors in Howard’s trial
last summer.
“The issue of the appeal that
was raised by the defense is one
legal argument only,” Beck said
via email Monday morning.
“They claim we got the wording
of the indictment wrong. They
are not contesting any of the
facts that led a jury to finding
him guilty”
Nancy Howard was robbed
of her purse and shot in the tem-
ple inside the garage of her
Carrollton home on Aug. 18,
2012. She suffered serious inju-
ries as a result of the shooting —
including the loss of her left eye
— and required multiple surger-
ies and rehabilitation.
Her alleged shooter, Michael
Lee Lorence, is on trial this week
before 362nd District Court
Judge Bruce McFarling.

The Second Court of Appeals
is set to hear oral arguments
from John “Frank” Howard’s de-
fense team next month at the
Denton County Courthouse on
the Square.
Howard, 55, filed an appeal
after he was convicted last Au-
gust by a Denton County jury for
plotting to commit capital mur-
der and paying numerous peo-
ple to kill Nancy Howard, his
wife of 30 years.
He was sentenced to life in
prison and must serve 30 years
before he is eligible for parole.
The Second Court of Ap-
peals, based in Fort Worth, sent
notice of the oral argument to
counsel Friday. The hearing is
set for 1:30 p.m. Sept. 22, ac-
cording to the notice.
Officials with the Court of
Appeals said Monday morning
that traveling courts aren’t out of
the ordinary.
The general counsel for the
Court of Appeals was not avail-

handle John
Howard’s ap-
peal.
‘We have confidence Mr.
Howard’s conviction will be va-
cated by the Court of Appeals,”
Gladden said by telephone
Monday.
The appellant’s brief states
that the “trial court erred when
denying the defendant’s motion
for a directed verdict of ‘not
guilty’ at the close of the state’s
case-in-chief [the prosecution]
based on insufficiency of evi-
dence, given the total absence of
evidence in the record to sup-
port a jury finding that the de-
fendant ‘shot’ Nancy Howard
with a firearm ‘for remuneration
or the promise of remuneration’
as alleged in the indictment.”

attorneys, Ricky Perritt and Jer-
ry Cobb, were not returned as of
