Man arrested after saying he
is ‘allowed to break the law’
Police charged a 25-year-old
man with public intoxication
and possession of drug para-
phernalia on Monday afternoon
after an unusual encounter with
several officers in the 1000 block
of West Hickory Street.
Joseph Augustini was taken
to Denton City Jail in lieu of
$500 bail for each charge.
About 1:30 p.m., officers re-
sponded to a report of a man
jumping into traffic near East
McKinney and Oakland streets,
according to a press release from
Denton police. They found him
in the 1000block ofWest Hicko-
ry Street with black makeup or
ink on his face, arms and torso,
police said.
Augustini told officers, “I am
the law,” and later repeatedly said,
“I’m allowed to break the law,” ac-
cording to police body camera
footage. Police
believed he was
intoxicated on
“a substance
other than al-
cohol” during
the encounter,
the release said.

trying to assassinate me, yes or
no?” Augustini asked officers,
according to police footage.
Officers eventually took him
into custody and discovered he
had a clear glass pipe with resi-
due that tested positive for am-
phetamines, the release said. Po-
lice did not know whether men-
tal health issues played a role in
the incident.

Lane — A 55-year-old man
was arrested on a criminal tres-
passing charge Monday morn-
ing after police found him at
Vanilla Family Dentistry,
where the man previously had
been issued a notice of criminal
trespassing, according to a po-
lice report.
The owner of the business re-
ported the man at 9:19 a.m. The
man, who also had an outstand-
ing Denton police warrant for
public intoxication, was taken to
Denton City Jail.

Moseley succeeds Bill Ham-
mond, who announced his re-
tirement after 18 years as the
TAB leader in Austin.
Following an extensive
search process, the Texas Associ-
ation of Business executive com-
mittee has appointed Moseley to
lead the organization, which
serves as the state chamber of
commerce.
The TAB advocates for busi-
ness and chambers of commerce
across Texas.
Moseley’s resume includes
stints as the state’s head of eco-
nomic development under
Govs. George W. Bush and Rick
Perry and as the CEO of the
Greater Houston Partnership,

been turned over to his lawyers.
The following year, the Su-
preme Court returned Lave’s
case to the Texas Court of Crimi-
nal Appeals for additional re-
view after lawyers argued his
trial attorneys weren’t able to
cross-examine a co-defendant
and challenge damaging state-
ments from him.
The 5th U.S. Circuit Court of
Appeals last year rejected Lave’s
appeal that contended the judg-
ment against him was the result
of prosecutorial fraud and mis-
conduct. That is the appeal the
high court refused to review
Tuesday. In Segundo’s case,
DNA evidence also linked him
to the rapes and strangling of
two women in the Fort Worth
area in 1994 and 1995.

HOUSTON — Two men on
death row for separate slayings
in the Dallas-Fort Worth area
lost appeals Tuesday before the
U.S. Supreme Court.
The justices refused without
comment to review the cases of
Joseph Lave, 52, and Juan Se-
gundo, 54.
Lave was condemned for a
November 1992 robbery at a
suburban Dallas sporting goods
store where two 18-year-old em-
ployees — Justin Marquart and
Frederick Banzhaf — were fatal-
ly bludgeoned with a hammer
and nearly decapitated. He re-
ceived a life prison term for
Banzhaf’s killing at the store in
Richardson and a death sen-
tence for Marquart’s slaying.
Segundo was arrested nearly
19 years after an 11-year-old Fort
Worth girl was raped and stran-
gled in her home in 1986. A
DNA match in a national data-
base in 2005 tied Segundo to the
slaying of Vanessa Villa.
Neither Lave nor Segundo
has an execution date.
Lave was set to die in 2007

deputy city manager and chief
operating officer, is scheduled to
present information on a local
proposition that would “freeze”
property taxes for homeowners
who are disabled or age 65 and
older.
