Friday of last week, I had a ride offered to Austin and took advantage of it
for the purpose of conferring with Capp, et al about the progress of the

tending the date for filing of statement of facts to March 17th, 1954.

tAually, there is nothing to complain of in this, for we would have no
fnd basis for opposing the extension of time. The record which we made
as so voluminous that the reporter simply has not been able to transcribe
is yet. I learned, of course, while in Austin, that this motion had been

. -n of findings of fact and conclusions of law, of which a tentative draft is
enclosed. This will no doubt be revised considerably before it is presented
to Judge Betts. Zollie, Capp and I were interested in talking over with Judge
Betts the procedure for filing of the findings. A court's findings are theoret-
ically found by the court, but actually in practice, are drafted and submitted
for the court's approval by the interested parties. Procedure is informal
arnd is whatever the court may direct. Judge Betts indicated that he wanted us
prepare findings and conclusions and confer with him and with counsel for
:.e railroads and intervenors when their requests and proposed findings are
submitteded.
It will be of interest to youthat Judge Betts seemed thoroughly sold on the
merits of our case, and in my estimation will go along with us on any findings
properly substa1tiated.
