Texas Attorney General Abbott recovers over $1.86
million for Texas after Medicaid fraud investigation
Texas Attorney General Greg from the Medicaid program." said
Abbott recently announced the Attorney General Abbott. "Like
recovery of $1.86 million for the many other companies that have
exploited the Medicaid piogiam
for profit, this business has seen
the error of its ways and is pay-
ing for ripping off Texas taxpay-
Texas Medicaid program follow-
ing a multi-state investigation of
Gambro Healthcare Inc. and its
subsidiary, (iambro Supply Corp.
I he total recovery reflects the
amount defrauded from the pro-
gram. which comprises the state's
partnership with the federal gov-
ernment for managing this pro-
gram.
Gambro used its subsidiary
supply company to fraudulently
bill Medicaid for equipment it
provided to patients undergoing
kidney dialysis treatments at
home, resulting in excessive pay-
ments to the company from the
government health care program
"1 am pleased this company is
returning the money it swindled
ers.
Gambro billed Medicaid
through its subsidiary at a higher
reimbursement rate than was al-
lowable by law, resulting in
Texas’ and other states' Medic-
aid programs paying far too much
for the dialysis services. Dialysis
helps in the removal of toxins
from the blood when a person's
kidneys cannot perform this
bodily function.
The settlement also resolves
allegations that Gambro orches-
trated unnecessary tests and ser-
vices in which physicians were
paid kickbacks based on their re-
ferrals to Gambro's facilities I lie
slates were wrongly billed for
these medically unnecessary
tests.
The total nationwide restitu-
tion to Medicaid, with penalties
and interest, is $37.5 million and
relates to similar schemes to de-
fraud 40 other states from Janu-
ary 1991 through September
2004.
Attorney General Abbott's
Medicaid F raud Control Unit and
those of other states investigated
the company and its practices. As
part of the settlement. Gambro.
w ith offices in several states, w ill
permit the U.S. Department of
Health and Human Services Of-
fice of Inspector General to scru-
tinize its billing practices for the
next five years.
