President Weyman Adamek opened the meeting followed bv
introduction of Rotarian Tom Loftin’s guest, Joe McManus from
Shiner. The Yoakum High School guests w ere Matt Eckstrom, 1 nc
Hawkins and Shane Johnson.
A1 Mechler passed along his weekly w eather trivia telling mem-
bers of a 54,000 square mile desert that has the w orld's second
lowest average rainfall of 3 inches coupled with nights registering
11 degrees and days of 113 degrees - made us all happy w ith our
Texas weather
Program Chairperson Sherry Hutchinson introduced Dale
Turner, pastor of Austin Street Baptist Church w ho presented a
very informative program on hospice care.
We have two hospice sen ices in our area. Both are there to
provide care and counseling to terminally ill patients who have
been certified by their physician to have six months to live. Most
families who have gone through hospice care with loved ones
report that it brings comfort and understanding in the most diffi-
cult of times. Hospice provides a caregiv ing team of professionals
and volunteers who serv e patients and their families to allow that a
patient dignity and comfort in death.
Mr Turner stressed the critical need for volunteers and the great
ditYerence just one hour a month could mean to a patient and the
patient's family. If you are interested in volunteering your time for
this w orthy cause you can contact one of the following v olunteer

At the conclusion of the program. President Adamek closed the
meeting with the Four-Way Test.
First Quarter tax payments due
January 31 is the deadline for
taxpayers that qualify to make
their first quarter payment.
The quarter payment program
only applies to homesteads with
an over 65 exemption or a dis-
abled exemption.
Under the quarter payment
program, taxes are paid in four
installments without penalty and
interest. A contract must be
signed each year.
Contact the tax office at (361)
275-3419 if you have any ques-
tions.
A reminder to taxpayers that
penalty and interest of 7 percent
begins on Feb. 1. The penalty
increases two percent each month
until June. The penalty and inter-
est for June is 15 percent on Julv
1 it goes to 40.7 percent.
The tax office does accept par-
tial payments on both current year
and back taxes If back taxes are
ow ed, a contract can be signed for
36 months to pay off the delin-
quent taxes. Signing a contract
and making regular monthly pay -
ments can prevent a suit from
being filed.
The DeW itt County tax office
will be relocating in February to
115 N. Gonzales.

employer’s account Is my hus-
band liable for the check or is the
company'1 Does my husband
have any rights against his em-
ployer for all of the bounced
cheek fees he incurred as a result
of his paycheck being returned ’
\ When your husband cashed
the check he endorsed it. Placing
his endorsement on the check
makes him responsible for the
amount of the check. In other
words, the store that cashed the
check has the option of going
against either your husband, or
the company that wrote the check
If your husband pays, however,
lie has a claim against the com
pany that wrote the check.
In my opinion, your husband
is also entitled to damages against
his employer for the amount of
fees incurred for checks that
bounced as a result of his pav -
check being returned. 1 suggest he
immediately let his employer
know that he expects them to pay
the check, and compensate him
for all of the fees he incurred as a
result of their check bouncing.
Q My daughter had a baby
and is living with the baby's fa-
ther Are they married? He say s
he isn’t What rights does she
have if he leaves'.’ He is taking
care of her and the baby but is
threatening to leave her.
A. Under the law. if he is the
father of the child, she has the
right to receive support for the
child. She is entitled to child sup-
port regardless of w hether they
are married.
You seem to believe, however,
that because they are living to-
gether with a child, they are mar-
ried That is not the law. For them
to have a common law
marriage based on living to-
gether. they must agree to be mar-
ried and hold themselves out as
married If they are just "liv ing
together" and have not agreed to
be married or held themselves out
as married, they are not married
Q. I live with my fiance. We
hav e decided not to get married,
t an 1 sell the engagement ring
and use the money to get a new
place to live?
A As a general rule in lexus,
an engagement is considered a
conditional gilt I he gill is given
on the condition that you gel mar-
ried Whether (lie ring must be
returned, however, depends on
who breaks off the engagement.
If the man calls it off. most courts
sav the woman may keep the ring.
If the woman calls off the wed-
ding, or the decision is mutual,
the ring must be returned.
Based on what you say. you
have mutually agreed to end your
relationship. If that is the case, my
opinion is that you must return the
ring.
Q 1 just moved here from an-
other state Is my will still valid?
A. If an out-of-state will com-
plies with requirements of Texas
law it is valid in Texas. Because
the laws of each state differ, how-
ever, the effect of the w ill could
be different in Texas. My advice
is to have an attorney either re-
view your out-of-state w ill or pre-
pare a new one.
1 should point out that it may
in fact be less expensive to sim-
ply have a new w ill prepared. Pre-
paring a simple w ill is not a diffi-
cult task. Many attorneys charge
a very reasonable fee to prepare
a will. Reviewing an out of state
w ill, on the other hand, could in-
volve more time and cost more.
Additionally, if the attorney
finds the will to be invalid, or in-
consistent with your desires, you
still must have a new one pre-
pared.
Q. 1 agreed to do some carpen-
try work for someone. After just
a lew weeks they canceled the
contract. They owe me $183 and
refuse to pay. How can I force
them to pay what they owe me?
A. You can’t "force them" to
pay you. but you can use our ju-
dicial system to try to collect.
This sounds like the perfect
matter for small claims court. I
suggest you send a certified let-
ter. letting the person know you
expect to be paid, and if you are
not. you will consider a claim in
small claims court. Hopefully this
w ill be enough to get the matter
resolved. If it is not. contact your
local justice of the peace about
tiling a claim in small claims
court.

Chamber Update
C hamber President. Vicki 1 auer, presided over her first Cham-
ber meeting on January 18 2005. Vicki was very clear about her
goal for 2005 - promoting and supporting the business commu-
nity Numerous ideas to accomplish this are being developed and
will be unveiled in the next couple of months.
It was especially pleasing to chamber directors to have 10 visi-
tors from the business community. Mike Hernandez from the Yoa-
kum Community Hospital addressed the need for chamber busi-
ness sponsored mixers.
Many individuals sit in coffee and beauty shops to discuss so-
lutions to area business/economy problems. If anyone has a sug-
gestion that 1) can be implemented and 2.) would have a positive
effect, please come to one of the monthly meetings to share your
ideas. Or contact a director or the chamber office. If you have a.
specific idea to present to the Chamber Board, please call the Cham-
ber Office and asked that you he put on the agenda at least a w eek
prior to the scheduled meeting
If the chamber and business members work hand in hand, the
local business environment can be positively impacted. So put
Tuesday. 2 15. on your calendar as that's the date for the February
meeting. The meeting will start at 6 p.m. and will be held at the
Community Center.
Also, a few tickets are still av ailable for the Chamber Banquet
on I 27 05. Call the
chamber office at 293-2309 for more information. A S12 ticket
will buy you excellent food, great entertainment, and fellowship
with friends and business associates.

It Lions Club Update
Lion Mike Reinhardt (on the left) and Lion Bill Natho were awarded
with monarch 25 year chevrons for their years of service in the
Yoakum Lions Club Lions President Nobles presented the awards
at the Lions noon meeting on January 18. 2005
Presenting the program to the Yoakum Lions Club members at
their noon meeting on January 18,2005 was Tim Fox, a CPA from
Seguin.
Mr. Fox reviewed the various changes in the tax laws pertain
ing to both individual and business tax return changes. Individu-
als and business entities that itemize their deductions need to be
aware of the many changes Mr. Fox recommended e-filing in
order to receive refunds sooner and cautioned everyone to give
close attention as to where to sent the return in order to expidite
receiving any refund.
The speaker addressed questions from the Lions w ho found
the program interesting and informative.
Lion Joe Sutton is shown displaying the commendation he received
from International Lions President recognizing him for 48 years of
membership in the Yoakum Lions Club. Lion Sutton has served in
all local offices of the Yoakum Lions as well as having served as
District Governor. Lion Joe was applauded for his commitment
during such a long time to serving his fellow man through Lions

Free tax help available in Yoakum
Income tax time has come
again and the Tax-Aide counse-
lors w ill he back to help again 1
the Tax-Aide counselors are
volunteers who have received
training by instructors taught by
the Internal Revenue Service rep-
resentatives and AARP trained
personnel. Each year they offer
residents free help in filling out
tax forms.
This w ill be their 18th year in
Yoakum. The counselors will be
at a new address this year. They
will he in the new Mitchell
W. Harbus, Jr. Municipal
Building at 307 Crittenden St.
Yoakum. Texas from Feb 7
through Apnl II from 1-5 p.m.
Tax help is available to every
one, but is especially targeted u
wards the elderly and low income
families.
When visiting the counselors,
tax payers are asked to bring
records of their 2004 income and
any outstanding expenses, the in-
come tax form from last year and
their 2004 IRS packet it they hav c
already received it in the mail
For those with a complicated
tax situation, it is best to cheek
with the IRS or a local tax con
sultant
