That the Commissioners’
Court of Comanche County,
Texas met in a Regular Meet-
ing on the 8th day of Decem-
ber, 2008 with the following
members present: James R.
Arthur, County Judge presid-
ing; Garry Steele, Commis-
sioner Precinct #1; Kenneth
Feist, Commissioner Precinct
#2; Bobby Schuman, Commis-
sioner Precinct #3; and Jimmy
Dale Johnson, Commissioner
Precinct #4.
Commissioner Steele
opened the meeting because
of a temporary delay of Judge
Arthur.
Kenneth Feist made a mo-
tion with a second by Jimmy
Dale Johnson to approve as
read the minutes of the No-
vember 24, 2008 meeting. All
Ayes. Motion Carried.
Bobby Schuman made a
motion with a second by Ken-
neth Feist to approve as read
the minutes of the December
1, 2008 meeting. All Ayes.
Motion Carried.
Patsy Henninges discussed
changes in the water flow from
CR 382 after improvements
were made to the road. Mrs.
Henninges stated water diver-
sions above her property and
water coming off of the road
caused water to drain onto her
property. It was recommended
that Commissioner Schuman
& Commissioner-Elect Sides
meet Mrs. Henninges onsite to
evaluate the situation.
James Rucker and Thomas
Harrison met with the Court
to request permission to erect
a flag pole on the Courthouse
grounds. The flag pole would
be used to fly a different con-
federate flag each month.
Judge Arthur questioned the
legality and stated further study
would be required. No Action
was taken.
Kim Miles, Texas Agri-
cultural Extension Service,
requested approval of a lease
on a copier for the Extension
Office. The new lease price
remains $189.00 per month.
Garry Steele made a motion
with a second by Jimmy Dale
Johnson to approve the lease
on a copier with Kirbo’s for the
Extension Office. All Ayes.
Motion Carried.
Open bids on Precinct #3
equipment. Jimmy Dale John-
son made a motion with a sec-
ond by Kenneth Feist to accept
the bid from Parham Garage
& Wrecker Service to sell (1)
one old Mac Truck Classic-
wrecked for $400.00 and (1)
one Chevrolet 1-Ton Truck
with no motor for $1,025.00
from Precinct #3. All Ayes.
Motion Carried.
The County Retirement
Plan was discussed. The em-
ployee can choose the with-
drawal benefit package at re-
tirement. The 10 & 15 year
option allows the employee to

benefit from the portion con-
tributed by the employee and
also the County contribution.
The lump sum package allows
for benefits from the share con-
tributed by the employee only.
Bobby Schuman made a
motion with a second by Ken-
neth Feist to purchase two
trucks for Precinct #4 from
Schlumberger for $10,000.00
each. All Ayes. Motion Car-
ried.
Garry Steele made a mo-
tion with a second by Jimmy
Dale Johnson to approve an
increase for all county em-
ployee salaries for the month
of December only. All Ayes.
Motion Carried.
Ray Heiberg informed the
Court that Comanche County
received the Governor’s Divi-
sion of Emergency. Manage-
ment Homeland Security Grant
for 2008. Comanche County
will receive $50,862.50. The
grant will be used for radios.
Commissioner Schuman made
a motion with a second by
Commissioner Johnson to ap-
prove the Homeland Security
Grant. All Ayes. Motion Car-
ried.
Garry Steele made a motion
with a second by Bobby Schu-
man to enact a Bum Ban for 90
days with allowances for weld-
ing with a spotter and attended
cooking in a closed container.
All Ayes. Motion Carried.
Jimmy Dale Johnson made
a motion with a second by
Bobby Schuman to approve an
order prohibiting rockets and
fireworks with fins. All Ayes.
Motion Carried.
Bobby Daniels presented
estimates of cost to evaluate
strength of the well at the North
East comer of the Courthouse.
Jimmy Dale Johnson made a
motion with a second by Garry
Steele to engage Harris Drilling
to evaluate well and estimate
pump horsepower needed to
irrigate the Courthouse lawn.

TEXAS COMMISSION ON ENVIRONMENTAL QUALITY
NOTICE OF CONCENTRATED ANIMAL FEEDING
OPERATION APPLICATION
General Permit Authorization No. TXG920276
APPLICATION. Marcel Herman Volleman, 1741 County Road 353, Dublin,
Texas 76446 ljas applied to the Texas Commission on Environmental Quality
(TCEQ) under General Permit No. TXG920000 for authorization to expand an
existing dairy cattle facility from 3,750 head to 6,000 head, of which 3,500 are
milking cows in Erath and Comanche Counties, Texas. The notice of intent
was received by TCEQ on January 17, 2008. No discharge of pollutants into
the waters in the state is authorized by this general permit except under chronic
or catastrophic rainfall conditions or events. All waste and wastewater will be
beneficially used on agricultural land.
The existing facility is located at 1741 County Road 353, near the town of Dub-
lin, in Erath and Comanche Counties, Texas. The facility is located in the drain-
age area of the Leon River Below Proctor Lake Segment No. 1221 of the Brazos
River Basin.
A copy of the notice of intent, application, the Executive Director’s technical
summary, and the CAFO general permit is available for viewing and copying at
the Comanche County Extension Office, 101 West Central #B101, Comanche,
Texas 76442 and at the Stephenville Public Library, 174 North Coumbia, Ste-
phenville, Texas 76401.
The Executive Director of the TCEQ has made a preliminary decision to approve
coverage of this facility under General Permit No. TXG920000.
PUBLIC COMMENT. Written public comments may be submitted to the
Office of the Chief Clerk, at the address provided in the information section
below, within 30 days of the date of newspaper publication of this notice. The
Executive Director will consider all relevant information pertaining to whether
the application meets the requirements of the general permit and will issue a
written determination as to any final action on the notice of intent of coverage
under the general permit.

vider. Shenff Lambert reported
dissatisfaction with this system
and they had failed to finish the
system in the past three years.
2) Infinity Network provides
a Jail Management System as
well as an inmate phone ser-
vice. Profits from the phone
system can be used to purchase
the new software. Jimmy Dale
Johnson made a motion with a
second by Garry Steele to ap-
prove the inmate phone system
with the Infinity Network. All
Ayes. Motion Carried.
Garry Steele made a mo-
tion with a second by Bobby
Schuman to approve the in-
mate commissary contract
with Lone Star. All Ayes. Mo-
tion Carried.
Ray Heiberg gave an up-
date on FEMA projects and the
ORCA Grant.
Sheriff Lambert requested
permission to install an au-
tomatic door opener at the
jail with the purchase price
of $1,850.00. The Dispatch
Board will be asked to pay a
portion of the cost. Commis-
sioner Schuman made a mo-
tion with a second by Garry
Steele to approve purchase of
the automatic door opener at
the jail. All Ayes. Motion Car-
ried.
Garry Steele made a mo-
tion with a second by Jimmy
Dale Johnson to approve the
Treasurer’s Monthly Financial
Report. All Ayes. Motion Car-
ried.
Jimmy Dale Johnson made
a motion with a second by
Kenneth Feist to approve the
Officer’s Reports. All Ayes.

motion with a second by Jim-
my Dale Johnson to approve
the Budget Amendments. All

which includes two trucks
purchased today. All Ayes.

approve payment of salaries
and related benefits coming
due prior to the December
22, 2008 meeting. All Ayes.
