Tuesday
,i $247 rji
granted a temporary injunction
on the use of the word 'yes'' on
. the Crosby High School marquee
promoting the bond election
March 22.
' The request for the injunction
was filed by Dan Flahertyihe-aL-
torney representing David
McGowani vice president of
Purcell Co. the primary
developer in Newport
The marquee, which gave the
date of the bond election and
.then said "Vote ves." will be
changed to read "Bond Election
March 22," Jake McAllister,
school board president, said
Tuesday after the hearing in the
judge’s chambers
'.'The law- is the law.'\
McAllister said.
He added that with all of the
money used to prepare the bond
issue for election, the $5 amount
cited in the hearing as the
amount estimated it cost the
district to add the word "yes."
which was interpreted
political advertising at the tax
payers' expense, is "trivial,"
McAllister said
The judge said that it was a
technical violation of a state law
"It looks ridiculous to me. but 1
can't ignore it. " Moore said.
it seems harmless." but a
violation of the law cannot be
overlooked. Moore said
Mo'ore gave the school board
the option to add the.words "or
no" to the sign or to-remove the
word "yes."
W ith a general consensus of
the four board members in at
. tendence. Sharon Bamberger.
Lois Shmidl. Tex Mitchell and
McAllister, it was decided to
remove the word "yes "
"I don't like to make this kind
of ruling." Moore said. He said
the Legislature makes the law,
and this one has no exceptions to
Jeff Davis, the attorney
representing the district,
challenged the injunction re
quest by citing that the marquee
■ is not printed material or a com
mercial sign as apparently
specified in the statue
The trial date on the case will
be set at a later time, and will be
heard in the 127th District Court
