Gentlemen:
Herewith attached certified copy of "Letters of
Administration" and court record of "Renunciation and Request,
Application, Oath and Bond, Letters Issued" in the matter of
the estate of Herman P. Faris, deceased, and photo copy of
unrecorded assignment of deed of trust from Wm. C. Lucas,
administrator of the estate of Herman P. Faris, deceased,
to the Benton Land Company. It appears that the original
assignment was never filed by Mr. Lyle for record. He had
the original assignment in his possession.
Also herewith enclosed is copy of letter from Mir.
Lyle and copy of letter from Benton Land Company in connection
with this title. With reference to the copy of Mr. Lyle's
letter attached, wish you would advise if you think it necessary
to record the assignment and certified copy of the Order b the
Henry County Probate Court.
Believe the enclosed papers, together with the ones
sent you recently, will enable you to now approve requirement
No. 12 of your requirement sheet dated November 2, 1959.
ith reference to the aiver of Deed of Trust by the
Wiggins family to the Lyle Family Trust, beg to advise that
our Mr. Glahn advises that the Waiver of the Deed of Trust
has been finally executed by Mr. Addison, the trustee, and
forwarded to Mr. Lyle at Kansas City.
If al requirements on this title have now been cured,
with the exception of the Waiver of Mortgage, please wire us to
this effect in order that we may pay the draft on or before
November 28 next. If the Waiver of Mortgage is received in
this office this week, will forward same to you for your approval
but in the event IEr- Lyle does not forward same to this office
until the first of next week it will then be too late to forward
to you for your approval before paying for the royalty under the
Wiggins land.
