REVERSED THE DECISION.
Knnf Supreme Court Uphold
Hie

Topeka. Jan. 0. Tho supreme court
reversed the judgment rendered in tho
district court of Atcliibou county in tho
case of the board of railroad commis-
sioners against tho Symmns Grocery
company of Atchison. "
Tho board made an order reducing
i rates of freight on carload lots of sugar
coueo beans and canned goods making
uiein considerably Jess than tho rates
on the samo commodities when shipped
I in less than carload lots. Tho Svmmn.
Grocery companv applied for "an in-
junction to restrain tho board from pnt-
ting tho new rate into ellect on the
ground that tho now carload rate wii
bo much below tho rate on le than
carload lots that it was a diH-ntninn-tion
against them their business mostlv
requiring thoni to use tho rates fixed.
. for less than carload lots.
Tho court holds that much discretion
is necessarily invested in tho state
board in determining what aro reason-
able and just rates and that so long as
it acts within tho limits of that dis-
cretion its acts cannot bo enjoined or
interrupted. Although not clothed
with all tho functions of a court thoy
aro authorized to determine what aro
just and reasonable rates.

1. All laws shall bo diligently on.
forced without fear or favor rich
or poor sporting oharaotor or any
other character.
2 . All business for "Waco shall be
done in a businesslike and legal
way; business for tho public like
business for the individual.
3. District Waco and compel
wide-walks such as each district
requires beginning with tho better
and more important business part
of town and growing cheaper as
we go into the residence and rural
part of town; but a sidewalk should
be built in front of every lot in the
uty of Waco. People who live in
town expect some advantages above
the couiitry.
I. Police judge ohiof-of police
and city attorney should be ap-
pointed by the oity conn lil leav
ing these men as oilicors nothing to
do but to enforce tho laws instead
of hunting votes from one term to
tho next. How many city attorneys
has Waco bad who have not been
suplemented by outside lawyers at a
big expense to the city.
f. It is a sin and a shame to
license crime but it is too iniquit-
ous for expression for a oily to put
its seal of approval by the author-
ity of the health ollicor of Waco to
save the inmates of tho houses of
shame advertising to tho mon of
Waco: You can break tho laws of
decency and not bo hurt; wo prom
iso you this by authority of law
no daimer here. Shame! Shame!
This law is too low down for decent
citizenship. There is said to bo
only one other city in Atuorioa so
low down in her laws and that will
so far prostitute her authority as to
protect aud encourage such shame
by the seal of approval as is done
in Waco. We condemn the law and
tho praotice and would forever
banish them from out the city.
0. Wo should spend less money
and have fewer teauhers in the
Central sohool and more teachers
and more room in our ward schools
which are the schools for the 00 in-
mon people the people for whom
free schools are intended.
7. Secure a city park a place
where the wago earner and all peo-
ple may go to breathe the fresh air
away from their orowded unshaded
homes. This is 3n imperative no
oeesity for the health and comfort
of our people.
s. Encourage and promote by
rewards the planting of 10000
shade tres along the Btreets of
Waco.
9. Sprinkle tho streets as a pub-
Ho health and comfort measure.
10. Have a. Bpeedily as possible
a perfect sewerage system that the
city can be clean as well as healthy;
beeides the great convenience.
Health comfort and protection
should be the first elements demand-
ed by legislation.
11. Have a pormanont eystem of
street paving not boomerang or
spasmodic but on a clearly defined
policy such an will give work to
our homo laborers and wage earnorB.
12. Cut down the salary of that
city ball gang wtfo stay by tho fire
in winter aud sit in the shade in
tho summer time and like tho lil-
ies of the field toil not neither
do they spin yet there iB not a tax
payer in all Waco arrayed like
these.
in. Know all wants and needB of
tho city by personal visitation.
11. Neither wink at crime nor
find fault with contractors' tax pay-
era or any other citizen; nor wink
at crime becauso it may secure a
vote; nor pet the reservation bo-
cause of the same; but treat all in
a manly legal cold businesB-like
way auoh as a business man who
succeeds would do business in his
business life.
15. The prosperity and fair name
of our oity can only be maintained
by impartial constant bUBineis-
like and legal methoJs.
18. .Publish quarterly an itemized
statement letting the tax-payers
who own the town know how we
stand in all things.
Lastly we are ready to give our
hand and most hearty support to
that business gentleman who will
adopt the above platform as we
believe it contains the plank heart
of oak which will stand the jars of
the ages and upon which the prin-
ciples leading up to success can
tand. Let there be no brow-
beating no faultfinding but a truth-
ful plain businesslike administra-
tion. Tho Waco Trading company
m'akes its bow returns thanks for
past favors and begs to again say:
