Lengthy Bill of Exceptions
Eiled in Seeking a ISFew
Trial!
Attorneys for John Leech have filed a
bill of 14 exceptions to perfect their ap
peal from the verdict of the jury which-
.found him guilty of the murder of
Ernest Kohlberg and fixed his punish-
ment at life imprisonment.
-The bill of exceptions which was
filed Wednesday afternoon in the dis-
trict clerk's office sets forth 14 differ-
ent counts on which an appeal is made
to the court of criminal appeals chief
among which it is alleged that the
V ccurt erred in permitting M. A. Cole
man to testify relative to threats made
three years previous by John Leech. The
arguments of the state's attorneys and
the charge of the jud-i are also ex-
cepted to. District attorney W. D.
Howe Is examining the bi!l and may
(modify it before t is sent to 'h. court
of appeals.
CHARG-E TWO WITH
' DEATH OF CARPIO
Francisco Apodaca and Gabriel Padilla
of Socorro charged with assault to mur-
der iwere .placed in the county jail Wed-
nesday afternoon and a. complaint
against them was filed in justice 31c-
Clintock's court Thursday morning. The
charge grows out of the death or C. C.
Carpio constable at Socorro who sus-
tained a pistol wound on November 30
that resulted in his death which occurred
in El Paso at Hotel Dieu.
Carpio is said to have been attempting
to arrest Raiael Carrasco at Socorro
when Apodaca is said to have interfered.
In the scuffle which ensued Carpio's re-
volver was discharged the bullet enter
ing his abdomen and perforating his in- j
testmes
EIGHT WITH WOMAN
FOLLOWS ACQUITAL
Shortly" after G. H. Houghani was ac-
quitted in police court Wednesday after-
noon ctf a charge of disturbing the
peace he and Minnie Howe a sister of
Ninnie Baird who preferred the charge
became engaged in a difficulty on San
Antonio street Both were arrested on
a charge of" fighting and the woman
spent theTiignt in. jail.
At the Wednesday' afternoon hearing
Minnie Baird testified that Hougham
compelled her to go with him to an E1
Paso street rooming house.

J. W. Gill was arrested- by customs

Frank Alderete as surety on a charge
of receiving and facilitating the trans-
portation of opium.

charge of the robbery of Sam Van
Hooyen a. diamond salesman. The case
was appealed and a new trial ordered
but Van Rooyen declined to come to
El Paso again and the case was dis
missed.

Steps to Secure Pecos
Valley Line.
Marfa Texas Dec 8. The Presidio
County club composed of Marfa's lead-
ing boosters held a rally at the club
rooms to discuss the subject of efforts
to induce the Pecos Valley railroad
to build its extension from Balniorhea
by the way of Marfa and Fort Davis.
The railroad company is as yet unde-
'-rcided as to whether it will take in
Alpine or Marfa and Davis.
A committee of eight Marfa men
was appointed to go over to Davis to
confer with the business men of that
place. They returned enthusiastic over
their reception at Davis. It was de-
cided to offer the Pecos Valley road
a consideration of $40000 $20000 from
Presidio and $20000 from Jeff Davis
counties the right of way and station
grounds. The committee was composed
of L. E. Cartwright L. W. Roberts
Mead Wilson J. A. Normand W. W.
Bogel M. Chastain H. M. Fennel and
Raezche.
Marfa's day trains will be put on
Sunday December 11. The westbound
passenger train wjll arrrive at Marfa
at about 8 a. m. and the tastbound at
6 p. m.

SOUTHWESTERN GOES BACIv
TO ITS OLD TIME CARD.
. Due to the changes in time of the
Southern Pacific the E. P. & S. W.
trains of the western division will re-
turn to the time In vogue a few days
ago. Previous to the announcement of
the change in the S. P. trains the
Southwestern altered its passenger
time in order to make better connec-
tions with the S. P. at Benson. The S.
P. change now has required a return
to the regular Southwestern time. The
passenger after Sunday will arrive at
4:05 p. m. leaving Benson at :05. F.

nected with the change of time.

-NORTH WESTERN YARDS SOON
Next week the deal whereby the
Mexico North Western Railroad com-
pany will secure yards in this city will
probably be closed. The property which
in to be purchased and on which the
railroad company already has an option
is located between Ninth and Tenth
streets east of Stanton street.

$3560 in Grarment; the
Owner Forgot.
An old red petticoat -with a pocket
containing $3560 met the gaze of Harry
Kibbs an employe of the Troy Laun-
dry Co. Wednesday afternoon as he
was sorting clothes at the la'undrv establishment-
Mr. Kibbs on hand-fng
the petticoat accidentally hit it against
a basket and heard the purse strike
the board.
On looking into the pocket its ex-
traordinary contents were revealed-
He immediately took the purse to the
office where the owner was notified
and the purse and money were re-
turned to her. Mr. Kibbs was re-
warded for his honesty.

HOLIDAY" VACATION
TO LAST TWO WEEKS
Christmas vacation for the EI Paso
public school children and the teachers
commences Dec. 20 and the schools will
be closed for two wees reopening on
Wednesday Jan. 4.
This was decided upon at the meet-
in? of the school hoard when several
hills were allowed. It is possible that
the .petition of the hiprh school students
to have athletics restored may be taken
up at the regular meeting next Monday
night.

Mrs. Elsie Roberts long a resident of
El Paso died Wednesday at her home

of age. Funeral services were held

Drivers Strike Eadx
Chicago 111. Dec. 8. The 'strike ot
deliverymen employed by the large re-
tail stores which threatened to pre-
vent Christmas lellverles has ended.
A compromise was reached which the
drivers say is a victory for tneci. The
men were promived a bonus of $15 each
to be paid on Cnristinas day two-

depot for the transfer of registered
